    Examples of Recent Adjudications:

     

    1. Domestic Violence: During argument with spouse, Employee broke spouses e-reader in half
    and pointed unloaded gun at dog’s head while dog was sitting in spouse’s lap. In mitigation,
    Eniployee had been struggling with spouses mental health issues and fol!owing this incident, entered
    marriage counseling. In aggravation, Employee introduced a firearm into a domestic dispute, an
    extraordinarily serious escalation.
    PENALTY: 45-Day Suspension
    OFFENSE: Assault/Battery, Offense Code 4.1
    2. DUI: Erriployee was stopped by police for driving private ly-owned vehicle while under the
    influence of alcohol. lt was Employee’s second DUI whUe employed by the FBI. A second DUI while
    employed at the FBI resuits in dismissal.
    PENALTY: Dismissal
    OFFENSE: DUI in Privately-Owned Vehicle, Offense Code 4.4
    3. lmproper Financial Relationship with a Source: Employee purchased a used car from a
    Confidential Human Source (CHS). Employee had previously served as the CHSs handler. In
    mitigation, Employee did not seek a discount, paid fair market value for the car, and is a valued
    employee with an excellent record.
    PENALTY: 3-Day Suspension
    OFFENSE: Improper Financial Relationship with a Source, Offense Code 1.2
    4. lmproper Handling of Evidence: Employee failed to properly secure and accurately account for
    evidence seized during a search warrant. Empioyee was in charge of irventorying the evidence.
    Employee failed to recount the currency to verify its correct amount prior to placing it in evidence
    vault, resulting in a subsequent discrepancy. Employee also failed to properly secure drug evidence
    in the safe, instead co-mingling it with non-valuable evidence. In mitigation, Employee was
    responsible for multiple duties on the day ofthe search and was overburdened. In addition,
    Employee is a nine-year employee with no previous disciplinary matters.
    PENALTY: 3-Day Suspension
    OFFENSE: Investigative Deficiency, Offense Code 1.6
    5. lmproper Handling of Evidence; Lack of Candor Not Llnder Oath: Employee failed to follow
    Bureau procedures for the destruction of drug evidence. Employee did not weigh each item prior to
    destruction, despite specific instruetions to do so from the Evidence Control Technician and
    Employee’s supervisor. Also, Employee improperly stated all drug eviderice had been properly
    weighed. In mitigation, Employee was attempting to adhere to a tight timeframe; Employee verified
    there was no tampering with any packages prior to their destruction; Employee’s coriduct did not
    negatively impact pending investigations; and Employee self-reported his misstatements. In
    aggravation, Employee’s actions in failing to follow the proper procedure served as a poor example to
    more Junior employees and Employee was under administrative inquiry at the time for unrelated
    conduct.
    PENALTY: 8-Day Suspension
    OFFENSE: Investigative Deficiency, Offense Code 1.6
    Lack of Candor Not Under Oath, Offense Code 2.5
    6. lmproper Relationship with Criminal Element; Lack of Candor Under Oath: Employee
    engaged in a romantic relationship with former boyfriend (now husband) knowing he was a drug
    user/dealer. Employee also lied under oath when questioned during the administrative inquiry about
    her husband’s activities. Prior to polygraph exam, Employee adnitted husband’s drug use, inciuding
    being aware when she married hirn that he was a habitual drug user’ who sold drugs to rnake
    money. PENALTY: Dismissal
    OFFENSE: Lack of Candor Under Oath, Offense Code 2.6

    An FBI special agent accused of driving on the State Thruway in Eden without wearing pants will see his charges dismissed if he steers clear of additional trouble for the next six months.

    John A. Yervelli Jr., 48, assigned to the Buffalo FBI office, was granted an adjournment in contemplation of dismissal Tuesday night in Eden Town Court.

    Yervelli was charged with misdemeanor public lewdness last month by State Police. A truck driver told troopers Yervelli was driving a passenger vehicle about 9 p.m. Dec. 7 when the off-duty FBI agent “pulled up next to his truck, turned on the dome light and displayed that he was not wearing pants, while making lewd gestures,” according to State Police.

    An Erie County prosecutor Wednesday confirmed this week’s court ruling, and said Yervelli is required to complete a psychological counseling program as part of the decision.

  • Teachers’ Problems, Unions,Strikes India,US.

    The recent strike by the Teachers is causing concern in the US.

    The major issue is the Evaluation of the Teachers.

    This problem is quite normal in India to the extent where we can predict when the Teaches would go on strike and for what.

    Normal issues in India, are.

    Wages.

    Transfers.

    Reservations for jobs.

    While wages is a common problem through out the world, the Transfers and Reservation in Jobs are unique in India.

    In State run schools,for getting transferred to  is an Industry by itself.

    The minimum going Rate for transfer is rs 100.000!

    A sham of ‘Counselling’ is done.

    This is a formality if one were to grease the right palms.

    Reservation is a process where that if you belong to certain social group(called Caste), you get priority.

    Your qualification/experience does not matter.

    This is done as an atonement for ‘the Oppression of the Group’ by the Society in the past.

    Normally there is hardly anything against this principle , but there are at least two or three a year agitating for inclusion of one or another group in the Reservation List.

    It will be interesting to note that till date there has been NO agitation concerning  Education by Teachers.

    Wages,yes, they are underpaid by the standards of other professions.

    While the Teachers in State run Schools get a Higher pay, teachers in the Private Sector are paid one-third of the State pay( excepting in some cases where they can not do with out good teachers)

    While Physics,Chemistry,Mathematics,Biology and English for Higher class Teachers get a Higher pay other Teachers such as Regional language,Physical Training,LKG/UKG,Computers,Social Studies are paid a pittance.

    Managements,since they pay a minimum wage encourages students to have Tutoring done by the Teachers of the Schools to enable them to make extra money and even in this the Schools take a percentage , normally 33 %!

    Unions are basically three types.

    Of The Ruling Party.

    The Opposition and

    The Communist oriented, which will switch sides mostly depending on who is in power.

    Strikes are not education centric at all..

    Academic evaluation system  does exist only marginally.

    So there is no question of raising the issue.

    Coming to the issue of Unions in the US,

    Teachers unions are to blame for low test scores and high dropout rates.

    ‘Where the unions matter most in the education debate is in their influence on how teachers are supervised and evaluated, who is granted tenure, and who is dismissed. These have all been flash points in Chicago.’

    There is abundant evidence that school districts don’t do enough to retain the best teachers or weed out the low performers. For instance, a 2009 report by the New Teacher Project found that 94 percent of teachers in Chicago received “superior” or “excellent” ratings, and just four in 1,000 were rated “unsatisfactory.” Considering the poor performance of Chicago’s schools, there’s no way nearly all of its teachers are superlative. Clearly, the evaluation system is broken.”

    The evaluation of Teachers is an ongoing process and as such one can not arrive at a decision on this.

    As I have indicated in my earlier blog the evaluation is subjective as the Students are not quantities to be measures and the system of education is not focussed whether it is job oriented or Value oriented.

    As there are different grades of Students such as below average,Average and above average, it becomes difficult to evaluate the Teachers on the basis of teaching in a Class consisting of all these three categories.

    Teachers unions are similar to private-sector unions.

    Like unions representing autoworkers or flight attendants, teachers unions focus on workplace issues. They engage in collective bargaining with management for wages, benefits and other conditions of employment.

    But teachers unions are different from private-sector unions in some fundamental ways. For starters, in the private sector, companies can go bankrupt. This generally creates a check on unions’ demands at the negotiating table because neither side wants an employer to downsize or go out of business. Public schools don’t go out of business. Officials involved in the Chicago negotiations said the union’s early demands for salary increases of more than 30 percent were impossible for the cash-strapped city.

    In the private sector, there are genuinely two sides negotiating contracts. But teachers unions and other public-sector unions often exert power on both sides of the bargaining table. They exercise political pressure by supporting candidates financially, with coveted endorsements or by calling voters. Because school board elections are often held separately from other elections and have low turnout, teachers’ unions often dominate them. Autoworkers don’t get to pick the board of directors of the car company; but teachers, in effect, can.”

    True.

    Stanford University political scientist Terry Moe says getting teachers unions to embrace reform is like asking a cat to bark, because unions are fundamentally about protecting their members and can’t be counted on to improve schools. Yet there are some examples of labor and management working together to bring about change in education.

    In Pittsburgh seven years ago, a teachers union leader and the city’s superintendent began to work together to involve educators in decisions about closing schools and revamping the teacher-evaluation system. And in New Haven, Conn., in 2009, the teachers union and the city agreed on a new evaluation system that includes students’ test scores as well as classroom observations. Last year, 34 teachers lost their jobs based on the new system.

    Today, with a new union leader and a new superintendent, reform is slowing in Pittsburgh. And in New Haven, many observers believe it was the threat of unilateral action by the mayor that got the union to make a deal. Regardless, under the right circumstances, even superintendents who have locked horns with their unions say they can be partners to effect reform.”

    Generally True.

    As is wont in Democracy it more the Party than issues that count.

     “What’s good for teachers is good for students.

    Union leaders like to say this. It’s an appealing sentiment, and it’s sometimes true. When the teachers unions protect education spending in state budgets, that’s good for students. But there are times when students’ and teachers’ interests diverge.

    Consider some of the big sticking points in the Chicago teachers strike: One major issue was what to do with teachers displaced by layoffs as a result of declining student enrollment. According to sources involved in the negotiations, the union wanted to keep teachers who could not find a new teaching position on the school district’s payroll indefinitely. A similar policy has cost New York City more than $100 million in pay to teachers who are not teaching. That sort of job security is obviously good for adults, but using scarce education dollars to pay hundreds of people who are not working is clearly not good for students.

    Teacher contracts are loaded with such inefficient provisions. In a 2007 analysis for the think tank Education Sector Marguerite Roza estimated that provisions that are popular with unions but have a weak or nonexistent relationship with student learning, such as arbitrary limits on class size and automatic pay raises, consume almost 20 percent of an average school district’s budget — more than $77 billion in nationwide education spending annually.

    So as we’ve seen in Chicago, what’s good for teachers is only sometimes good for students.”

    By the very nature of the group they are representing the Unions refuse to see the larger picture.

    It is the basis for their existence.

    All said and done as stated in Hinduism Education is personal and it can be imparted best personally paying attention to the student individually by one whose character is unimpeachable and whose authority can not be questioned.

    The Society must undertake to support the Teachers and accord them the Highest respect and the teachers must realize that their profession is one of the noblest and they shape a generation and in the eyes of a man a good Teacher is the lasting influence.

  • CEO Bloodies Staff For More Video Content!

     

    The craze for getting viewer-ship is becoming a Disease.When I saw the Film,’Island’  I felt that the film was a fantasy.

    Seems that it is real.

    NEW YORK—Screaming at the top of his lungs like a deranged lunatic and drenched in his own blood as well as the blood of his employees, Grind.com CEO Jeff Potkul went berserk Friday and demanded his staff produce more web video content or he would “fucking kill them all,” sources at the arts and entertainment website confirmed.

    According to staff members, after learning that competitor sites were garnering more video plays per month, the 56-year-old Potkul snapped, let out a violent shriek, and began pounding his fists on his desk and punching his computer monitor until his knuckles were bloody.

    “We need more videos!” Potkul reportedly screamed, emerging from his office and glaring directly at each of his employees, who stared back in shock and quiet confusion as the wild-eyed executive assumed a fighter’s posture and methodically breathed in and out, punctuating every exhalation with a slight snarl. “Videos with bands! Videos with cool places! Funny videos! Random videos! More web videos! More! More! More!”

    “You think I’m joking?” added Potkul, who then grabbed the 3-wood from his golf bag, sprinted across the office toward his senior web producer, jumped onto his desk, and beat him over and over with the club until he lay dead in a puddle of blood. “Anyone else got a problem with making more web videos?”

    Throughout the 45-minute tirade, which caused a reported $500,000 in property damage, the crazed CEO kicked down cubicle dividers and whipped staplers at his staff, all the while shrieking, “Celebrities! More videos with celebrities!” In addition, between overturning desks and stomping on computer keyboards, the seething, rabid executive told his employees that if they see something, anything, they had better “get out [their] little fucking cameras, make a fucking video out of it, and put it on the goddamned Internet.”

    At one point, witnesses said, Potkul rushed to an office window and began banging his head on the glass, opening a gaping wound on his forehead that caused streams of blood to cover his face.

    “Video on the Internet is where it’s at,” Potkul said through gritted teeth as, for reasons that remain unclear, he began to choke himself. “Everyone’s doing videos. Everyone!”

    With a crimson foam spewing from his mouth each time he shouted the word “viral,” Potkul reportedly ordered his staff to form a circle around him, after which he ripped off his shirt and called out the names of employees one by one, urging them to take him on.

    “Fucking pussies can’t even make more web videos—of course you’re too chicken shit to challenge me,” said the CEO, who finished each taunt by taking a shard of glass from the shattered conference-room door and slicing his own chest without blinking or flinching. “That’s the kind of passion you need to make more videos online. Come on, come at me! Right here, right now!”

    As he ran around the office screaming “Ya ya ya ya ya ya ya” in what seemed to be an imitation of a Native American warrior, Potkul often interrupted his wild chant to yell out random media buzzwords such as “social presence,” “responsive site,” “integration opportunities,” and “eight-episode web series.”

    Toward the end of the verbal and physical onslaught, Potkul relieved his bowels in the middle of the office floor, rubbed his body in the excrement, and told employees that nobody was leaving until there were 40 more videos online.

    “I tried to run for the elevator but he caught me,” content producer Erica Klein told reporters, adding that she was surprised how quickly Potkul moved. “He grabbed my neck, lifted me off the ground against the wall, and started strangling me. He said he wouldn’t let go until I came up with three new original video ideas that would work for BMW’s new ‘Live Sophisticated’ campaign.”

    “That’s when he made me watch him bite his own tongue in half,” she added.

    According to Grind.com employees, this isn’t the first time Potkul has gone berserk. Sources said the CEO once cut off all his clothing with scissors and viciously headbutted each member of his marketing team when he felt the company’s Twitter following wasn’t strong enough. And in May he lit an intern on fire after overall page views dipped.

    “[Potkul] said he didn’t care if the new videos were 45-second-long heaping piles of shit, just so long as there were more of them and we could put advertising before, during, and after each clip,” said a senior staff member speaking on condition of anonymity. “I mean, I’m down to make more videos, but they’re actually pretty hard to do, and we really don’t have enough people on staff to do more. If I told him that, though, he’d rip my larynx out with his teeth like he did to Kenny.”

  • Recruit Female Employees, Get Paid More-Corporates. Feminists?

    Corporate Companies and Business Houses are reported to be paying extra Service Charges(Commission is euphemistically called) for recruiting female Employees.

    The HR Consultants are being paid an extra of between 2-10 % for Recruiting Females.

    Deutsche Bank pays  @% more and some others up to 10 % more if the Organisations hire Females.

    We do not know how much more incentive the Company’s HR Department gets paid.

    Sodexo does not accept candidates by the Recruiters if female candidates are not included while Kotak Mahindra  goes in for only females for internal jobs.

    One can understand if the recruiters are advised and paid more for sending qualified and experienced candidates irrespective of Gender.

    All of us know why women are selected as Receptionists and Customer Care Center Executives.

    To pay more in the form of Commission because the candidate is a Female..?

    Is this not more damaging to Women?

  • Man Issues Bomb Threat in Job Application

    “Both landing a job and finding a way to fulfill sexual fantasies can be difficult things to do. Sadly, after writing a bomb threat on the back of his restaurant job application, a man in Nebraska is no closer to achieving either goal.

    Let’s break down where it all went wrong for Jason Dornhoff, 38.

    Realizing he did not have a job, Dornhoff decided to apply for a job. So far so good.

    For his prospective place of work, ABC News reports that Dornhoff selected the Legacy 272 Restaurant & Lounge in Kearney, Nebraska. The Legacy 272 Restaurant & Lounge looks lovely and has all-you-can-eat crab legs for $30 Friday and Saturday night. Fantastic.

    Dornhoff drove to Legacy 272, asked for, and received a job application. Perfectly executed.

    He filled out the application. Simply da bomb.

    Speaking of da bombs, Dornhoff wrote on the back of his application that he had one in his truck.

    That would be where it all went wrong.

    Here’s what the note Dornhoff handed to his future coworker said:

    “I have no money, a huge bomb in my truck, and a syringe of bleach that will kill you instantly. If you be quiet and help me, you won’t die.”

    The employee “processed Dornhoff’s application” aka “called the police” a little after 11p.m. (kind of late to be filling out a job application, but no judgments here). Cops found him sitting at the bar when they arrived.

    According to court documents, Dornhoff, in a sharing mood, told the police he uses methamphetamines and went to the restaurant hoping to find a way to fulfill his sexual fantasies. “Hoping to find a job” might have been a better thing to say.

    Police found neither a huge bomb nor a syringe of bleach that will kill you instantly in Dornhoff’s truck. He is scheduled to appear in court in August.
