  • Is This All There Is

    People, after a certain age, tend to change.

     

    Especially those who have crossed 50, more so after 60.

     

    They make it a regimen to go for a Walk religiously every day,start diet restrictions,try to withdraw to themselves and pretend that they are not interested in things which they think belong to Youth.

    Surprising!

    Life does not happen in compartments.

    It is a flow in alignment with the individual’s dispositions.

    Because one turns  over in age, does not mean he is to change his likes and dislikes.

    You have not been able to do the things you wanted to earlier because of your career, Family commitments.

    Now you are free to do what you like and enjoy doing.

    And there is no pressure.

    Unless,

    You have the mistaken impression that decisions taken by your children , in the family, means that you are sidelined,

    You feel that you have to be consulted for everything,

    You have the arrogance to think you are always right’

    Your decision is final.

    Remember how many times have  we felt, in the past,that these pressures of running the day-to-day affairs and wished others would share the burden, especially children.

    And we train the children towards that end.

    Then why this confusion?

    Do what you like, without affecting the Family,maintain a detached attachment.

    If you feel alright, no need to follow the myth imposed on the aged-be your age,do pooja regularly,go for a walk, restrict your diet….the recommendations are endless.

    Do what you like and enjoy Life.

    You have only one to Live.

     

  • Concessions Privileges Senior Citizens Details

    Yesterday I posted on Free Pilgrimage facilities for the Senior citizens.

    I was requested to post on a List of concessions for the Senior Citizens in India.

    Here is a List.

    1.Income Tax Rebate.

    Income tax rebate upto an income of Rs. 1.85 lakh p.a.

    Higher rates of interest on saving schemes of senior citizens.

    A Senior Citizens Savings Scheme offering an interest rate is 9% per annum on the deposits made by the senior citizens in post offices has been introduced by the Government through Post Offices in India doing savings bank work.

    Private banks also offer.Watch out for their announcements.

    2.Travel.

    1. Reservation of two seats for senior citizens in front row of the buses of the State Road Transport Undertakings.
    2. Some State Governments are giving fare concession to senior citizens in the State Road Transport Undertaking buses and are introducing Bus Models, which are convenient to the elderly.

    In Trains.

    Men – 60 years and aboveWomen – 58 years and above

    – traveling for any purpose.

    — 40% in all classes– 50% in all classes

    — Also in Rajdhani/ Shatabdi/ Duronto trains

    Wheel Chair facilities are available at Most Railway Stations.

    1. Courts in the country accord priority to cases involving older persons and ensures their expeditious disposal.

    A senior Citizen is one who has completed 65 years in the case of a man and 58 years in the case of a Lady.

    The Central Government is considering the lowering the age of Senior Citizens from the present 65 years to 60 years.

    “The state government has proposed to bring the age of senior citizens down from 65 years to 60 years. This would mean 30 lakh more people under the senior citizen category, taking the total number of beneficiaries to 1.30 crore.”

  • Parents Abuse By Children India Law For Maintenance Details FAQs

    We find in India, senior citizens being abused and ill-treated by their children.

    Many dump their parents in OLd Age Homes.

    This behaviour is not restricted to the poorer sections alone.

    Affluent sections also resort to this, dumping parents in old age Homes , verbal abuse and  refuse to maintain them.

    he Maintenance and Welfare of Parents and Senior Citizens Act 2007

    What are the important features of the Maintenance and Welfare of Parents and Senior Citizens Act 2007?

    Ans. The Maintenance and Welfare of Parents and Senior Citizens Act 2007 envisages providing need-based maintenance to the parents/grand parents from their children. Tribunals will be set up for the purpose of settling the maintenance claims of the parents in a time bound manner. Lawyers are barred from participating in the proceedings of the Tribunals at any stage.

    The Maintenance and Welfare of Parents and Senior Citizens Act 2007 also contains enabling provisions like protection of life and property of senior citizens, better medical facilities, setting up of old age homes in every district, etc.

    What is the applicability of the Act?

    Ans. The Act extends to the whole of India except the State of Jammu and Kashmir and it applies also to citizens of India outside India (Section 1(2))

    When will the Act come into force in the States?

    Ans. The Act come into force in a State on such date as the State Government may, by notification in the Official Gazette, appoint (Section 1(3)).

    What is the definition of Child/children under the Act?

    Ans. The Act defines “children” as son, daughter, grandson and granddaughter who are not minor.

    What is the definition of Maintenance under the Act?

    Ans. The “Maintenance” includes provision for food, clothing, residence and medical attendance and treatment;

    What is the definition of a Senior Citizen under the Act?

    Ans. A “senior citizen” means any person being a citizen of India, who has attained the age of sixty years or above;

    Who are eligible for claiming maintenance under the provisions of the Act?

    Ans. The Act provides that a senior citizen including parent who is unable to maintain himself from his own earning or out of the property owned by him, shall be entitled to make an application for claiming maintenance.

    Whether a person other the claimant can file application on his/her behalf?

    Ans. An application for maintenance may be made

    1. by a senior citizen or a parent, as the case may be; or
    2. if he is incapable, by any other person or organization authorized by him; or
    3. the Tribunal may take cognizance suo motu.

    Whether there is any provision for the Tribunal to order subsistence allowance to the claimant during the proceedings?

    Ans. The Tribunal may, during the pendency of the proceeding regarding monthly allowance for the maintenance under this section, order such children or relative to make a monthly allowance for the interim maintenance of such senior citizen including parent and to pay the same to such senior citizen including parent as the Tribunal may from time to time direct.

    What is the time limit for disposing an application for claiming maintenance?

    Ans. An application filed under sub-section (2) for the monthly allowance for the maintenance and expenses for proceeding shall be disposed of within ninety days from the date of the service of notice of the application to such person. However, the Tribunal may extend the said period, once for a maximum period of thirty days in exceptional circumstances for reasons to be recorded in writing.

    What is the monitoring mechanism for implementation of the Act by the States?

    Ans. The Act has been enacted in pursuance of the provisions of Article 41 read with Entry 23 of the Concurrent List (Schedule VII) of the Constitution of India. State Governments are required to notify the Act and frame Rules for implementing the provisions of the Act.

    However, Section 30 of the Act enables the Central Government to give directions to State Governments for carrying into execution of the provisions of the Act. Further, Section 31 of the Act provides for periodic review and monitoring of the progress of implementation of the Act by the State Governments. The Ministry will act in accordance with these provisions to ensure effective implementation of the provisions of the Act by the States.

    Has any timeframe has been prescribed for setting up of Tribunals by the States?

    Ans. The State Government are required to constitute for each Subdivision one or more Tribunals as per the need within a period of six months from the date of the commencement of this Act.

    What is the effect of the order of maintenance?

    Ans. A maintenance order made under this Act shall have the same force and effect as an order passed under Chapter IX of the Code of Criminal Procedure, 1973 and shall be executed in the manner prescribed for the execution of such order by that Code.

    Who can appeal to the appellate Authority under the Act?

    Ans. Any senior citizen or a parent, as the case may be, aggrieved by an order of a Tribunal may, within sixty days from the date of the order, prefer an appeal to the Appellate Tribunal:

    That is the time limit for an appellate authority to dispose of the appeal?

    Ans. The Appellate Tribunal is required to make endeavours to pronounce its order in writing within one month of the receipt of an appeal.

    Is there any penal provision for enforcement of maintenance order of the Tribunal?

    Ans. Yes, the Maintenance Order given by the Tribunal will have the same effect as the maintenance order passed under Section 125 of Cr. PC. This will include imprisonment upto One month and issue a warrant for levying the amount due in the manner provided for levying fines.

    What are the provisions about revocation of will?

    Ans. As per the provision of Act, a senior citizen can seek to revoke any property, which has been transferred in favour of children/relative on the condition that such children/relative would provide maintenance to him but are not providing the same. The tribunals are empowered to declare such transfers as void on the applications of such parent.

    Is any penalty/imprisonment is for the children who abandon their parents?

    Ans. Yes, the Maintenance and Welfare of Parents and Senior Citizens Act 2007 contains penal provisions to discourage abandonment of parents by their children by imprisonment for a term of 3 months and a fine upto Rs. 5000/- or both on the children.

  • Bathroom Fracture, Safety Tips For Elders

    I have noticed that the cause of Death , for the elderly, seems to originate from a Fracture sustained in a Bathroom.

    This happens especially to people, generally of Good Health as well, when they use the Bathroom, both in the Day and at Nights.

    The Fracture occurs mostly is the Hips and despite every attempt to rectify it, the Fracture stays put and usually the people are bed ridden

    They develop complications, not necessarily associated with Fracture and that’s it.

    In the case of the infirm it is still riskier.

    If one has Sugar,Blood Pressure and a History fo Heart/ Lung Ailments, the treatment becomes difficult.

    Many seniors are injured in their bathroom when they slip and fall. The bathroom is very treacherous with  many hard surfaces and sharp edges. Common injuries include bumps and bruises and broken hips.  According to the Center for Disease Control 360,000 to 480,000 older adults sustain fall-related fractures each year. Carefully planned modifications can significantly reduce the risk of these devastating injuries.  In 2004 hip fracture hospitalizations for every 100,000 persons was 1,113 for women and 558 for men.  Another startling fact is many people die shortly after a hip fracture. This injury causes anImmediate Need for the patient.  Home modifications are often made prior to the patient returning home from a lengthy rehabilitation.

    According to a report from the Center for Disease Control:

    • One out of five hip fracture patients die within one year of the injury.
    • One in four adults who live independently before a hip fracture spend over a year in a nursing home after their injury.
    • Of the 500,000 hip fractures per year women suffer ¾ of all injuries.”

    How does one go about preventing these Fractures in the Bathroom?

    For starters, those above 60, must realize they are not getting younger and the body has a mind of its own, it refuses, at times to obey you,

    Understand this, no point in trying to look young and act young.

    Our time is past.

    Unless we realize this, we might be in trouble for ourselves and  a nuisance to others.

    Do not get up from the Bed at one stroke. wake up slowly, switch on the light and sit in the bed for a few minutes, then get down from the cot.

    Preferable to avoid searching for the slippers with the feet, chances are you might slip.

    Walk to the Bathroom slowly, switch on the light.Installing  a Lamp (0 watt) at the Bottom of the side wall will help

    2.Advisable to have  the Bathroom floor semi rough surface .

    Avoid glitzy smooth surface tiles.

    3.The Bathroom switch is to be fixed outside with dual control inside.

    4.Switch on and Off from the outside.

    5.Do not drink more water than necessary before going to Bed. and keep the Bathroom Dry.

    6.Suggested Modifications for the Bathroom.

    New shower: get rid of the old tub and remove the step over hazard. Construct a barrier free shower or install an acrylic barrier free unit. Install adjustable, fixed and handheld shower heads. Install grab bars and a pull down seat.

    Toilet: Install a elevated comfort height toilet with seat that will make it easier to get up and down. Install a strategically place grab bar near the toilet for the end user.

    Sink: install a lower mounted bathroom sink and leave the underside open for proper knee clearance and maneuverability.

    Home modifications that improve safety in the bathroom; minor bathroom modifications

    • Put a backless bench in the tub or shower
    • Add a handheld shower head
    • Install an elevated toilet seat or toilet riser
    • Correctly install grab bars, not towel racks in the shower and bath area
    • Purchase and lay large, nonskid mats
    • Install a phone in the bathroom
    • Install brighter lighting
    • Purchase a portable toilet for night-time use in the bedroom
    • Install a pocket door

  • Elders Being Killed In India

    What is more shocking is the revelation by a Field worker of an NGO  that the Elders are being killed in the Southern Districts of Tamil Nadu,India much in the manner of Infanticide where in tamil Nadu they resort to killing Female children by கள்ளிப்பால் the administering   juice of  Cactaceae.

    The Elders are killed by giving them Tender coconut Water and splashing them with very cold water , this is called ‘water splashing,தண்ணி சாத்துதல்  .

    The other method seems to be  by administering poison injection!

    Madurai, the Temple Town of India and Kanyakumari District have this dubious distinction with Cuddalore.

    Having had a look at the Statistics, we might look at the problem

    The problem as enumerated by the Elders.

    The problem of Solitude.

    One of the main causes for depression among the elderly is that their children do not spend much time with them even if they happen to live in with them.

    Another grouse is that children have left for abroad to pursue their careers.

    As one grows old whether it is your son or yourself your perspective and the equation of relationships undergo a subtle change.

    Children have their own official pressure, financial commitment and they have their own wife and children to cope up with.

    It is not fair to expect that the children behave and communicate with us the same way they have been with us after marriage.

    Wish those who complain on these lines might ask themselves  how they have been with their parents and if their parents were to be alive, they would be leveling the same charges against them.

    As to children going abroad, the children have a whole life head of them and now thy they have opportunities to earn more by going abroad, which we did not get at our time.

    So it is a question of one understanding what is good for the children at the economic front.

    Do not for a moment imagine that the children do not think of these problems and are selfish.

    In fact my son hesitated for even applying when an opportunity was awaiting. worrying as to how to leave me and my wife alone.

    I advised him that at most I might live for about 10 or 15 more years , he has a future to look forward o and that i had been taking care of myself and my wife before he was born!

    As to me being old I informed him that there are so many in the World without children and even if they have, for some reason or other could not live with them, all not because of abuse.

    I also told him , in the final analysis,one has come alone, lives alone and leaves alone, as a matter of fact.

    I think this seems to be a practical way of looking at the problem.

    Some parents are not interested to live abroad because they feel they would miss our society and Country.

    If you are not prepared to make any compromises at an old age, is it fair to expect youngsters to do so?

    Best is to develop an interest in something other than sentimental attachment to Family and go about doing what you love doing but were unable to during your early years.

    A gentle man stated that he has Sugar, had knee problem , he has been provided with TV,Laptop ,and all other facilities, and children respect him ‘ yet says he depressed because he has been asked by the Doctors and the family not to work!

    What does one say to him?

    Children do not respect.

    I think there is point in this.

    They tend to disrespect elders even when it is not warranted.

    They should remember that they would also become old one day.

    As to elders, do not offer advice or opinions  and interfere in the daily running of the family.

    We have been doing it for nearly 30-40 years!

    Why not leave it to other and relax?

    A bed-ridden 108-year-old woman was allegedly raped by her son’s friend at home in Jabalpur town when the rest of her family was out shopping on December 4. The crime was disclosed to HT on Friday by the president of the Jabalpur unit of the Mahila Congress after she took up the matter with Madhya Pradesh director general of police SK Rout in Bhopal.

    The accused, Gopi Ahirwar, 45, a waiter in a hotel, lives in the same locality of Sita Pahad in Jabalpur cantonment and was a regular visitor to the victim’s home.

    The victim, whose son is a daily wager, lives in the servant’s quarter of an army officer’s house. The victim’s granddaughter said, “As usual, we left the door open before leaving for the market that day as neighbours and relatives often visit our house to see my grandmother.”
