Rape Identities Protection Gays And Lesbians

The Verma  Committee  on Crime against Women , in its report has rightly concluded that the identities of the Rape need protection.

 

Another point comes to my mind.

 

Nobody approves a Rape much less a one which involves gang Rape as in the case of Jyoti Singh Pandey a.k.a Nirbhaya, Delhi.

 

(By the way, as one of  my readers pointed out how is it that Jyoti has two surnames?)

 

The rape accused have been arrested.

 

Under Law none is guilty, unless proved”

 

The media have been flashing the accused’s names with regularity and in fact they have already completed the trial.

 

What if they are proved ‘not guilty?”

 

Is it not proper to afford them the secrecy of their identities?

 

In a frenzy one should not forget the basics of law,otherwise this will be taken as a precedent for the later cases.

 

( Ram Singh, the bus driver, and his brother, Mukesh Singh, were both arrested in Rajasthan. Vinay Sharma, an assistant gym instructor, was arrested in Delhi,[41] as was Pawan Gupta, a fruit seller. A juvenile whose name has yet to be confirmed, though he has been referred as Raju a 17 years and 8 month oldminor[44] and native of Uttar Pradesh was arrested by the police at Anand Vihar terminal in Delhi. And, Akshay Thakur, a man who had gone from Bihar to Delhi seeking work, was arrested inAurangabad in Bihar(wiki))

 

The Verma committee goes on to make some profound observations.

“If human rights of freedom mean anything, India cannot deny the citizens the right to be different. The state must not use oppressive and repressive labelling of despised sexuality. Thus, the right to sexual orientation is a human right guaranteed by the fundamental principles of equality.

Pointing out that we need to remember that the founding fathers of our Constitution never thought that the Constitution is a “mirror of perverse social discrimination,” the report says, on the contrary, it promised the mirror in which equality will be reflected brightly. “Thus, all sexual minorities, including transgender communities, are entitled to be totally protected.”

“We must also recognise that our society has the need to recognise different sexual orientations as a human reality. In addition to homosexuality, bisexuality, and lesbianism, there also exists the transgender community. “In view of the lack of scientific understanding of the different variations of orientation, even advanced societies have had to first declassify ‘homosexuality’ from being a mental disorder and now it is understood as a triangular development and neurological underpinning owing to genetic reasons,” said the report.

Suggesting that correct knowledge must be disseminated in respect of sexuality and sexual choices without enforcing gender stereotypes, the report says children need to be able to access informed, non-prejudiced sources on sexuality. Challenging the perception of sexuality as being purely heterosexual is an ongoing agenda for lesbian, gay, bisexual and transgender activism and for counter-socialisation efforts. “Collaborating or networking LGBT activists is a beginning to understanding different sexuality experiences,” Justice Verma says in his report.

Recommending the use of theatrical resources and films in school workshops, which has proven to be extremely effective in gauging gender relations, the panel calls for the use of such audio-visual material to encourage respect and understanding for all genders and sexes.

 

What does The Committee want to convey?

1.Homosexuality along with Lesbianism, has to be guaranteed by The Constitution .

2.’Raping,Gang Raping,Sodomy,Public Exposure, Pedophilia  belong to ‘sexual orientation ‘ and Sexual Minority?

So, The Constitution has to approve of it?

What does the media have to do?

To high light more of the lurid details on-screen and print?

I reiterate that Rape is a vile Crime /along with Kidnapping and has to be dealt with severely but one should exercise caution in arriving at conclusions before the trail is complete.

    Do you even understand what you write or is it just a copy- paste???? Every aspect of human phenotype ( the way you look ) and behaviour has a genetic basis – called the genotype of the individual. That is all that the research you quote says. It gives a possibility of a possible gene that may contribute to homosexual traits in some individuals – even if we overlook the reliability of this data ( i’ll state the reason for that later ) – this by no stretch of imagination says about homosexualiy being a disorder. The high LOD score doesnot refer to a link between the gene and the trait ( homosexuality ) rather it refers to the fact that the five genes ( or markers ) are inherited together during meiosis – something a high school science graduate could have told you !

    As for the validity of the research –
    1. the study by virtue of its design, applies to only Homosexual Brothers and cannot be extrapolated to any other group.
    2. A sample size of 40 has a very low P value – that is the chances of co-incidence are too high.
    3. The study is silent on the statistical analysis of its result in terms of significance- no result can be accepted without this
    4. the hypothesis that since a trait follows maternal inheritance inheritance it is inherited by X chromosome is itself flawed – X linked inheritence has a specific pattern that follows a alternate man – woman – man pattern.

    I could go on but then I will need to get technical and I doubt you would understand unless you hail from a research background.

    And BTW homosexuality and skin colour are almost exactly the thing- both have a similar basis and similar cultural stereotypes that changed when bigots gave way to logical and sane thought and reason !

    You seem to have made quite a leap of assumption there.
    The Justice Verma Committee report is actually a landmark document that understands the importance of equality especially in relation to sexual orientation. And sexual orientation refers to whether I fall in love with a man or a woman or a crossdresser or a transgender or whomsoever I please. It is not just the act of having sex but the identity of that individual per se.
    Rape, Public Exposure, and Pedophilia are in no way sanctioned by the Recommendations nor are they sexual orientations. They are and will remain crimes under the Indian Constitution.

    And as far as the Committees stand on homosexuality is concerned I applaud the maturity in understanding this issue that the committee has shown. Homosexuality is a reality. It exists. It is life for people like us. And it in no way harms anyone.
    So why then discriminate against us ? Why deny us the right to live freely as an dignified member of this country?

      I understand.
      But, note the sentence,

      It is evident science does not know much about this and at the same time says that is due to Genetic reason.
      That implies it is not normal.
      Second point is that what is an Objective sexual knowledge?
      Any social norm can not be judged intrinsically but one goes by the majority of the behavioral pattern;this is not to say it is Right, as a Moral judgement.
      Social values/Norms are those which the Society has formed to maintain Social Order -those practices followed by the majority.
      If these systems do not exist, the Society will collapse.
      That’s all.
      Homo sexuality, Lesbianism both are different from Sodomy etc.
      While the first two due to imbalance genetically of hormones and psychological reasons, the rest are perversions.
      My point was and is that if one were to grant social acceptance to all behaviors that deviate from Norms then there will be no norms and the Society will not be able to distinguish Disorder and Perversions.
      While the former calls for understanding and support, the latter has to dealt with severely by The Law and the society.

        Science doesn’t explain a lot of things – IQ, texture of your hair, how a foetus grows in the womb, etc ….. all are subject of active research in genetics..all regulated by genes and influenced by environment… makes them abnormal phenomenon ????

        Science has categorically proved that homosexuality is a normal varient – like being tall or skin colour . It is NOT a disease ….. And while society can pick and choose about what it accepts or not (by the way societies also evolve and accept new ideas – eg interracial mairrage, women’s education,universal adult franchise) , the law must be drawn in black and white and if the law guarantees equality to all then it should mean ALL – everyone ……. And while the Committee report recognises the difference between normal human variation and criminal behaviour you obviously have failed to make that distinction in your post.

        And BTW i don’t know where you get your scientific knowledge from but i would recommend a revision of source – “While the first two due to imbalance genetically of hormones and psychological reasons” – there are no imbalances of hormones or psychological thoughts in homosexuality ……

        1.Genetics and Homosexuality are related.
        ‘A genetic analysis of 40 pairs of homosexual brothers has uncovered a region on the X chromosome that appears to contain a gene or genes for homosexuality. When analyzing the pedigrees of homosexual males, the researcheres found evidence that the trait has a higher likelihood of being passed through maternal genes. This led them to search the X chromosome for genes predisposing to homosexuality. The researchers examined the X chromosomes of pairs of homosexual brothers for regions of DNA that most or all had in common. Of the 40 sets of brothers, 33 shared a set of five markers in the q28 region of the long arm of the X chromosome. The linkage has a LOD score of 4.0, which translates into a 99.5% certainty that there is a gene or genes in this area that predispose males to homosexuality. The chief researcher warns, however, that this one site cannot explain all instances of homosexuality, since there were some cases where the trait seemed to be passed paternally. And even among those brothers where there was no evidence that the trait was passed paternally, seven sets of brothers did not share the Xq28 markers. It seems likely that homosexuality arises from a variety of causes.’

        Value judgments are not in Science’s Domain.
        It is the Society which determines the Society’s Norms.
        Difference in color is not the same as Homosexuality/Lesbianism.
