Justice Soumitra Sen not to be impeached! Why?

It is a fact that he has been charged with irregularities of the highest order,in fact fraud.

The Parliament witnessed him defend his actions.

The fact that he has tendered his resignation and that it has been accepted on Sunday the 4th of September,  should not be a hurdle in impeaching him.

Why has it been accepted?

Would you follow this procedure for a common fraudster?

To please the Judiciary, for favors to be shown to politicians who are queuing up to enter Tihar?

He should be set as an example.

I have seen in private companies  people are asked to resign on their own, but never for financial irregularities.

They will be sacked.

Follow this for a grave crime by a Judge and impeach him.

An active Supreme Court should intervene and set an example by suo moto action, by recommending impeachment.

Why are the Judges being let off like this?

I am aware that The Constitution does not provide for this measure, but it is time.

Lok Sabha Speaker Meira Kumar was holding consultations with ministers and leaders of various political parties ahead of her final decision on Sen’s impeachment.

“I have to consult because there have been new developments. I will be talking,” Meira Kumar told reporters outside parliament.

By new developments, she meant the resignation of Sen on Saturday which had led to an uncertainty over the issue amid speculation that the motion may be dropped.

But there was no official confirmation until Monday afternoon.

If the Oversight Committee feels that the charges proved against the judge merit his/her removal, it shall request the judge to resign voluntarily, and if the judge fails to do so, it shall advise the president to proceed with the removal of the judge. In such a case, the President shall refer the matter to Parliament, where the rest of the procedure is the same as the one in the case of a motion moved by MPs.
