Please see my blog ‘The original Document’ filed under Corruption.NEW DELHI: In what could add to the discomfiture of the government, finance minister Pranab Mukherjee has formally told Prime Minister Manmohan Singh and Congress President Sonia Gandhi that the ‘Office Memorandum’ from the Finance Ministry to the PMOon the 2G spectrum allocation was not the product of MoF’s solo effort but an inter-departmental exercise.In a four-page letter to Singh, delivered at the prime minister’s residence just when he landed in Delhi from Frankfurt on Tuesday night, Mukherjee said the document was drafted after detailed confabulations between his ministry, PMO, the Law Ministry, DoT and Cabinet Secretariat.The minister recalled that the note was essentially a backgrounder on the spectrum issue for helping the government put up a coherent defence on the matter. He also noted that it was prepared in the backdrop of demands from the Public Accounts Committee to summon Principal Secretary to the Prime Minister and the Cabinet Secretary for explaining the role of the PMO in spectrum allocation.
The letter noted that 22 meetings were held between various departments and that Vini Mahajan, joint secretary in the PMO, participated in many of these deliberations. Through his letter, Mukherjee appears to be trying to blunt the claim that the Office Memorandum (OM) was prepared by the Finance Ministry to embarrass Home Minister P Chidambaram.
The OM had suggested that some decisive interventions by Chidambaram could have averted the 2G scandal. Mukherjee’s letter contradicts Congress’ and Law Minister Salman Khurshid‘s line that it was the handiwork of a junior official and that it had “no life”.

2G Note by the Finance Ministry – Original Document.
Following is the original Document-The Finance Ministry’s Note on 25 march 2011 indicating Chidambaram agreed with the fixing of the price at old level.

The issue now is between Pronob Mukherjee and Chidambaram slugging it out.
The documents clearly shows Chidambaram knew and approved of the pricing of 2 G, contrary to what he has been saying till now.

Chidambaram okaying the old price. The earlier documents from PMO indicates Manmohan Singh was also aware of what was happening in DoT.
That the whole scam was conceived and executed jointly by Congress and DMK is evident.
Kick backs were traced only in the case of DMK, by nabbing Kalaignar TV and Kanimozhi.
What about tracing the the route taken by Congress?
Vigilant enquiries of Balwa and others could throw more light on the issue.

2G,From Criminal case to Political- Sonia Moves in.
The 2 G scam is becoming curioser..What started as a criminal case is slowly turning not into a civil case but into a Political one and also one that involves the opinions of the Ministries, thus paving the way for pitting one Constitutional Authority like CAG against Finance Ministry,CAG with DoT,MoF with DoT.
By diverting the attention to be caught in these semantics, path is cleared for arguing that the Supreme Court has no jurisdiction over what is purely an Executive decisions .
Note the earlier defense of Raja where he stated that all ,including MoF, and PMO were in the know of all his decisions and he had been given the go ahead.
The reaction of the DMK that the current position of the Government vindicates the DMK is natural and logical.
The case is heading for dismissal as things stand now, despite Swami’s valiant efforts.
Another intriguing aspect is the volte face by the CBI in the Supreme Court-there is no case against Maran in Aircel,then CBI has a case to nail Maran, TRAI and CAG ‘leaking’ documents that there is no financial loss; ‘Leak’ of Finance Ministry’s Note..

The submission of CBI that there is no case against Maran, ‘leak’ of Documents earlier of PMO’s Office involving the PM have surfaced when Sonia Gandhi was away from the picture.

The Finance Ministry‘s office memorandum,approved by Finance Minister Pranab Mukherjee released on Wednesday by Janata Party Chief Subramanian Swamy has put the role of Home minister P Chidambaram ] under the spotlight..
The 11-page note sent to the Prime Minister’s Office is talking about the meeting in January 2008 where the then Finance Minister P Chidambaram approved of the 2G spectrum pricing. He wasn’t seeking any change in it, claims the note.
The memo written on March 25, 2011 says that if Chidambaram wanted, the 2G spectrum could have been auctioned.
On March 25, 2011, Dr PGS Rao, deputy director in the Finance Ministry has written a memo to Vini Mahajan, Joint Secretary in the Prime Minister’s Office.
The note is regarding the allocation and pricing of 2G spectrum. This explosive note was accessed by a Vivek Garg, a Right To Information activist.
Some of the revelations in the note are surely going to damage Chidambaram’s stand on the 2G spectrum issue. The case of 2G spectrum case is at a sensitive stage where a special judge of the Central Bureau of Investigation court is going to frame charges soon. Government and Congress on Thursday stoutly defended Home Minister P. Chidambaram facing heat from a united opposition who pressed for his resignation and a CBI probe over his stand in the controversial 2G spectrum allocation….
Mukherjee, who is in New York, declined to comment on the raging row over the “secret” note, which appeared to have raised questions on the Home Minister’s stand when he was holding finance portfolio saying the matter is “sub judice”.
“I cannot make any comment on it. The whole matter is under the scrutiny of the Supreme Court of India. We cannot make any comment on any matter that is sub judice,” he said.
The note suggested that the 2G scam could have been averted if the Finance Ministry, then under Chidambaram, had insisted on spectrum allocation through auction.
“The party does not doubt his integrity,” Congress spokesman Abhishek Singhvi said, dismissing as “junior officer’s subjective judgement” the note by Mukherjee-headed Finance Ministry….

2G CBI questions Supreme Court on Chidambaram.
The CBI seems to be questioning, under the guise of legal non sense the authority of the Supreme Court in the 2G scam.
Its submission ‘
The CBI said that Supreme Court cannot give such an order and it is for the trial court to take a decision on the issue.
“Questions of any further investigation or addition of accused in the case have to be decided by the trial court and not by this court,” senior advocate K.K. Venugopal, appearing for the CBI, submitted before a bench of Justices G.S. Singhvi and A.K. Ganguly.
“Investigation is complete in 2G scam (during the tenure of Mr. Raja) and framing of charges is to be decided by the trial court. If the trial court finds that there is any wrong doer then it can add the person in the list of accused,” he said questioning the jurisdiction of the apex court to entertain Mr. Swamy’s plea.

amounts to questioning the Supreme Court.
Honorable lawyers seem to forget the entire case is conducted on the express orders of the Supreme Court.
Or does the CBI imply that the government does not want to include Chidambaram in the case?
I think the Supreme Court is being hinted to order the inclusion of Chidambaram in the 2G Scam case, by the CBI.
Better for the Congress to be ready to defend Chidambaram, to be followed by the PM.
