Rape,Legal Definition.
Indian law treats rape as a criminal offence. It falls under criminal law in India. The Indian Penal Code (IPC) defines rape as intentional, unlawful sexual intercourse with a woman, without her permission.
Indian Law On Rape.
“375. Sexual Assault: Sexual assault means –
(a) The introduction (to any extent) by a man of his penis, into the vagina
(which term shall include the labia majora), the anus or urethra or
mouth of any woman or child–
(b) the introduction to any extent by a man of an object or a part of the
body (other than the penis) into the vagina(which term shall include the
labia majora) or anus or urethra of a woman
(c) the introduction to any extent by a person of an object or a part of the
body (other than the penis) into the vagina(which term shall include the
labia majora) or anus or urethra of a child.
(d) manipulating any part of the body of a child so as to cause penetration
of the vagina (which term shall include labia majora) anus or the
urethra of the offender by any part of the child’s body;
In circumstances falling under any of the six following descriptions:
Firstly – Against the complainant’s will.
Secondly – Without the complainant’s consent.
Thirdly – With the complainant’s consent when such consent has
been obtained by putting her or any person in whom the
complainant is interested, in fear of death or hurt.
Fourthly – With the complainant’s consent, when the man knows that
he is not the husband of such complainant and that the
complainant’s consent is given because the complainant believes that the offender is another man to whom the
complainant is or believes herself to be lawfully married.

Rape Facts and Myths.
“Myth: Rape is caused by lust or uncontrollable sexual urges and the need for sexual gratification.
Fact: Rape is an act of physical violence and domination that is not motivated by sexual gratification.
Myth: Once a man gets sexually aroused, he can’t just stop.
Fact: Men do not physically need to have sex after becoming sexually excited. Moreover, they are still able to control themselves after becoming aroused.
Myth: Women often lie about rape or falsely accuse someone of rape.
Fact: Statistical studies indicate false reports make up two percent or less of the reported cases of sexual assault. This figure is approximately the same for other types of crimes. Only one out of 10 rapes are actually reported. Rapes by someone the victim knows are the least likely to be reported.
Myth: Women provoke sexual assault by their appearance. Sexual attractiveness is a primary reason why a rapist selects a victim.
Fact: Rapists do not select their victims by their appearance. They select victims who are vulnerable and accessible. Victims of sexual assault range in age groups from infants to the elderly. Sexual attractiveness is not an issue.
Myth: Sexual assault is a topic that only concerns women, and men do not have to be concerned about sexual assault.
Fact: According to recent rape crisis center statistics, men, both straight and gay, suffered 10 percent of the sexual assaults reported in the United States last year. In addition, men have wives, friends, sisters, mothers and daughters who may someday need assistance in coping with sexual assault. Rape is a concern for everyone.
Myth: If a woman really did not want to be raped, she could fight off her attacker.
Fact: Even if the rapist is not carrying a weapon, the element of surprise, shock and fear or the threat of harm can overpower a survivor.”

Now that Nirbhaya, the girl who was gang raped in New Delhi has died,people are waking up to the reality of Rapes in India.
The Western newspapers are awash with articles on the subject.

I found a reasonable good one which analyses the issue of rape.

Following are the reasons cited.
Fewer Female Police Personnel.
True
Even the quality of women Police available is disheartening.
I have found the women Police to be more heartless than a Policeman in terms of character and humane approach to family issues brought into Police Stations.
These women Police ensure that they get a good bribe to settle the issue even if what is agreed upon is totally unjustifiable.
Lockup rapes are most common.
Recruiting good material for the workforce will be the right step.
And the training of Police force, both Men and women must be scientific and they must be made people friendly.
‘Delhi, for example, is home to one of the largest metropolitan police forces in the world with some 84,000 officers. But only one-third are involved in any kind of actual “policing” at any given time, while the rest provide protection services to various politicians, senior bureaucrats, diplomats and other elites. According to the Times of India there is one officer for every 200 citizens and about 20 officers for every VIP. Many of those who do perform police duties can be found shaking down motorists, participating in protection rackets and simply looking the other way as crimes take place.’
Yes, the strength of The Police Force must be increased
Useless and avoidable deployment of Police Force for the Security of Politicians must be dispensed with(most of the politicians deserve to be a security risk and I wish they succumb to the threat!)
Blaming Provocative Clothing.
There’s a tendency to assume the victims of sexual violence somehow brought it on themselves. In a 1996 survey of judges in India, 68 percent of the respondents said that provocative clothing is an invitation to rape. In response to the recent gang-rape incident, a legislator in Rajasthan suggested banning skirts as a uniform for girls in private schools, citing it as the reason for increased cases of sexual harassment.
I disagree with this point in that while Rape is not the direct outcome of provocative clothing, one can not deny that provocative clothing provokes.
Even the term ‘provoke’ is used by the author to indicate the rekindling and egging of the desire!
Women, for their safety, must ensure they do not wear dresses that expose their body.
One never knows how many perverts are up there, who imagine bedding every thing in sight!
Asking women to be careful is not a denial of their rights.
Acceptance of Domestic Violence.
True.
This is to be addressed by the families of the men and women.
Here I mean the domestic violence by women as well.
Lack of Public Safety.
True with the rider that one can not roam about bars frequented by the flotsam and jetsam of the society.
The attempt to compromise the rape issue outside the Court also encourages the incidence of rape.
The point to be observed is that while people who talk highly fo liberation of women and self-professed Liberals, How Many of them are prepared to take a girl who was raped as one’s daughter in-law or men who will marry such a girl?
This will take some time.
As things stand, the Court hearing can be held in camera , to begin with.
Sluggish court system, Low Convictions and the low status of women.
Agreed.

The Lifestyle of Drinking, late night Partying , adoption of Western values, loss of family values, Single parenting do have a major role to play.

I have been under the impression that the Rape Testa conducted on the victims of sexual attack is very scientific and advanned.
To my shock this is how the ‘Rape Test’ is conducted in India.

‘An international human rights group urged India last week to ban a “degrading and unscientific” test commonly performed on rapevictims to see if they have previous sexual experience.
In the test, a doctor inserts fingers into the victim during the forensicexamination to test for “vaginal laxity” and is expected to deliver a medical opinion as to whether she appears to be “habituated to sexual intercourse.” The group, Human Rights Watch, argued that the testconstituted a second assault on a traumatized woman”
Is this the way the this issue is being handled?
Why do we have A Ministry of Women and Child Development?
What have the courts been doing, being blind to the tests conducted?

“The level of care – including counseling – provided to the New Delhi gang rape victim and her family, demonstrates that political will can ensure support and care for victims of sexual assault, Human Rights Watch said. But this only followed public outrage and demonstrations after the attack. Human Rights Watch research has found that survivors usually find it difficult to register police complaints, and often go from one hospital to another even for a medical examination, and often report suffering humiliation at police stations and hospitals.
India does not have a uniform protocol for medical treatment and examination of survivors of sexual assault, making responses ad hoc and unpredictable, and in the worst cases, degrading and counter-productive. This is reflected in the continued use of the so-called “finger test,” which Human Rights Watch documented in a 2010 report. While conducting medical examinations, many doctors record unscientific and degrading findings, which involve noting the “laxity” of the vagina or hymen, apparently to determine whether the victims are “virgins” or “habituated to sexual intercourse.” Often doctors, police, and judges look for evidence of “struggle” or “injuries,” especially hymenal injuries, in the medical examination report, discrediting those who do not report such injuries.”

The girl who was brutally gang raped, died in Mount Elizabeth Hospital in the early hours of Saturday ,29/12/12.

At least now let’s introspect where we went/are wrong and try to ensure that women do not suffer this fate in future.
Agitation sin Public,screaming ,damaging public property and the sensationalism by Television Channels with their eyes on TRP of the issue, will not solve the problem.
The process of punishing the Rapists should be swift within a short time frame and there would be no Adjournments during the Trial.
Let us remember we have our Mothers,Sisters, Wives and Daughters as well.
Let us curb the instinct of trying to bed every woman in sight.
Let us revert to our system of Family values, such as respecting elders,treating women with courtesy.
Let us go to the rescue of the women in distress instead of being Voyeurs.
When I say ‘We’ I Include Women.
Resolve that we will not dress provocatively in the name of freedom of women.
Freedom shout will not bring the dead girl alive.
Shun the midnight outings ,pub culture.
Accompany your women folk in the nights.-this includes your girl friend , if you are serious about the relationship.
If you are in need of sex, visit places reserved for these activities.
Imbibe the Western Culture for Discipline,Industry,eye for Detail and not for anything else.
Remember, other wise the next victim could be your Mother,Sister, Wife or Daughter.
‘Story:
“The patient had remained in an extremely critical condition since admission to Mount Elizabeth Hospital,” hospital chief executive Kelvin Loh said.
“She had suffered from severe organ failure following serious injuries to her body and brain. She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome.
“We are humbled by the privilege of being tasked to care for her in her final struggle,” Mr Loh said.
A team of eight specialists had tried to keep the patient stable, but her condition continued to deteriorate over the two days she was at Mount Elizabeth Hospital, he added.

According to the police, the victim is a medical student from Dehradoon, who is doing her internship in Delhi. Her friend an Engineer both boarded a private bus with tinted glass window from Munirka, south Delhi to Palam around 9.45 Pm. Her friend told police that the men on bus harassing her, which he confronted them. After that all incident happen, he was hit by the iron road several times on his head and the women dragged to driver’s cabin, where she was R*ped and later both victim threw out the bus. Police filed the case against the rapist and send both victim’s to AIIMS, from where main victim refer to Safdarjung Hospital due to her critical condition.
Brutality.
On Tuesday morning when the victim came to sense, after 36 hours did not able to speak. She write on a paper “Life my leg and clean my throat”. According to the doctors of SafdarjungHospital the condition of the victim is very critical; her pulse rate is 130 which are more than normal. Her plates and blood pressure are going up and down. Doctors say that they are watching this kind of brutally case first time in his career, only a psycho can do this kind of work.(hit latest)
