Is he eligible to become the Prime Minister of India?
He has declared thus thrice,once there is overwriting on ‘Indian ‘citizen.
The story.
Rahul Gandhi had declared himself a British citizen in the registration papers of a private company in London, BJP leader Subramanian Swamy alleged today, a charge that the Congress has dismissed.
Mr Swamy today released documents along with his letter to Prime Minister Narendra Modi demanding that the Congress vice president be stripped of his Indian citizenship and Parliamentary membership. The documents, he said, show that Mr Gandhi had called himself “British” on the annual returns of a UK-based firm “Backops Limited”. The 45-year-old Congress leader was the director and secretary of the company, according to the documents that the BJP leader said he had extracted from the company law authorities of Britain.’
BJP MP Subramanian Swamy, recently claimed that Rahul Gandhi has 4 passports, one in the name of Raul Vinci and has a chapel at home, during the event ‘India ka DNA Conclave’, organized by Zee News. The BJP leader further claimed that Congress President Rahul Gandhi does not have an M.Phil degree as he flunked his economics paper.
Government of India, whether it is The Congress or the BJP have been saying that the information from the Swiss Banks can not be declared as it has to be kept to secret as per the Treaty with the Government of Switzerland on Double taxation.
I decided to have a look at the Treaty between India and Swiss Confederation.
Here I quote the relevant clauses on the sharing of the information, obtained from Swiss authorities on Black money stashed in the Swiss Banks.
Notification G.S.R. NO. 357(E),dtd. 21.4.1995.
EXCHANGE OF INFORMATION
The competent authorities of the Contracting States shall exchange such information (being information which is at their disposal under their respective taxation laws in the normal course of administration) as is necessary for carrying out the provisions of this Agreement in relation to the taxes which are the subject of this Agreement. Any information so exchanged shall be treated as secret and shall not be disclosed to any persons other than those concerned with the assessment and collection of the taxes which are the subject of this Agreement. No information as aforesaid shall be exchanged which would disclose any trade, business, industrial or professional secret or trade process.
In no case shall the provisions of this Article be construed as imposing upon either of the Contracting States the obligation to carry out administrative measures at variance with the regulations and practice of either Contracting State or which would be contrary to its sovereignty, security or public policy or to supply particulars which are not procurable under its own legislation or that of the State making application.”
Clause 1 states that the information ,
shall not be disclosed to any persons other than those concerned with the assessment and collection of the taxes which are the subject of this Agreement.”
Also this information , will not be divulged.
‘which would disclose any trade, business, industrial or professional secret or trade process.’
In divulging the names to the Parliament or the public there is no disclosure of any trade secrets excepting the illegal gratification received and one will be divulging the names and details of accounts which are prima facie illegal, based on the Letter Regotary had been submitted.
That letter is issued only if there is prima facie case.
Hence it is a lie to say that the Government can not disclose the information and it has to be secret.
Now the clincher of a Clause in the Agreement is the Clause number 2 quoted here.
“In no case shall the provisions of this Article be construed as imposing upon either of the Contracting States the obligation to carry out administrative measures at variance with the regulations and practice of either Contracting State or which would be contrary to its sovereignty, security or public policy or to supply particulars which are not procurable under its own legislation or that of the State making application.”
Money laundering is contrary ‘sovereignty, security or public policy or to supply particulars which are not procurable under its own legislation or that of the State making application.”.
The Governments, whether the Congress or BJP has been lying about the Agreement with the Swiss is preventing them from divulging this information
Double Tax Agreement between India and Swiss Federation.
UK has a double taxation treaty similar to the one entered into by India with the Swiss Government.
According to UK, the following people will be affected.

Any UK individual with a bank account, trust or company in Switzerland will be affected by the agreement. Swiss banks will be checking their records to identify such individuals. If banks do not have current information about their customers, account-holders may be contacted when they do not meet the relevant criteria. They should contact the bank to avoid suffering the one-off levy, as outlined above.
Money from a wide range of sources is held in Switzerland, much of it for decades. Examples include:
People who have worked abroad and opened Swiss bank accounts to hold their earnings, and failing to declare the account on their return to the UK. Typical examples include those working in the oil and gas sectors, and money earned from international trade;
Inter-generational. A lot of “old” money has been held in Switzerland for two or three generations. This was the hardest for HMRC to “unlock”;
Money moved to Switzerland in the past to avoid exchange controls or international sanctions, particularly those applying to former UK colonies such as Rhodesia. This money could not be declared to HMRC because that would involve divulging the source;
Money hidden in Swiss bank accounts to avoid detection by a spouse, with a subsequent divorce. Spouses hiding their assets in this way may have perjured themselves during the divorce proceedings, and legal advice should be taken.

There is another disclosure in a book called The State within a State: The KGB and its Hold on Russia: Past, Present, and Future by Yevgenia Albats, a journalist working for Moscow News and Isvestia, published in 1994. It claimed that KGB funds had been sent to support the Congress as well as the family of the Gandhis. The author cites the KGB letter and file reference in her book. All major newspapers, the Hindu and the Times of India included, had carried the expose on KGB payments even before the actual publication of the book in 1994, when the KGB papers were unveiled in the year 1991-92. Even before Dr Albats’ book came out Russian media had leaked out details and, based on the leaks, on 4 July 1992, the Hindu had reported that “the Russian Foreign Intelligence Service admits the possibility that the KGB could have been involved in arranging profitable Soviet contracts for the company controlled by Rajiv Gandhi family”.

Earlier this month, the finance ministry objected to its Rs 4,000 crore joint venture project with the Gujarat government for a liquefied natural gas (LNG) terminal within Adani-promoted Mundra Special Economic Zone (SEZ).
As a direct fall out of this objection, the Board of Approval (BoA) for SEZ in its meeting held on April 3, has kept the final approval to the proposal “in abeyance”. This comes at a time when the stock valuation of the Adani group has touched an all-time high.
Documents of the IMG (inter-ministerial group) with The Indian Express show that the Adani group had requested co-developer status for the Gujarat government-led Gujarat State Petroleum Corporation (GSPC) Ltd for establishing an LNG terminal, storage and re-gasification facilities…
The finance ministry, explaining its stand on the business model, said, “There appears no justification for providing duty concessions on inputs or capital goods that will be used for these operations…the proposal does not envisage any physical export out of the country…further, the location of the SEZ, whether in processing or non-processing area, has also not been clarified…therefore, any decision of the BoA must address these issues in relation to the proposal.”
Previously, the expert appraisal committee of the ministry of environment and forest (MoEF) had given consent to the project in February 2014.
The Adani group and GSPC had entered an agreement in August 2013 for establishing a 2.95 lakh square meter facility; the proposal was also cleared by Cabinet Committee on Investments.”

Amid Rahul Gandhi’s ‘toffee’ barbs over giving land by the Gujarat government to the Adani group at throwaway prices, BJP has hit back saying the group got cheap land from earlier Congress-supported governments.
Records show the group first got wasteland in Mundra from the Congress-backed Chimanbhai Patel government in 1993 and then from another Congress-supported government headed by Shankersinh Vaghela in 1997.
The group subsequently got more wasteland from BJP governments headed by Keshubhai Patel in 1999 and Narendra Modi in 2005. While Gandhi has said that land given to Adani was of the size of Vadodara, the Ahmedabad-based group has got 7,350 hectares, as against Vadodara city’s area of 15,900 hectares. “

“BJP’s chief campaigner is selling Narendra Modi model in the name of Gujarat. What is happening in Gujarat under this model? Sikhs living there since past 50 years were being forced to leave the state,” Sonia said while addressing an election rally in Malwa belt of Punjab. “May God please save this country from this model,” she said.
She attacked the Akali Dal for joining hands with BJP and not raising its voice for the Sikhs in Gujarat. “Akalis rather than raising voice against them (BJP) are colluding with them and they are partners in this atrocity against Sikhs in Gujarat,” said Sonia. “In Gujarat every second five-year-old child is malnutritioned and those who get Rs. 11 per day are not considered below poverty line in Modi model,” she added.
Sonia said that around 45000 acres of land in Gujarat had been given to one businessman at a cheap rate and under this model several people in the villages are still not getting potable water.
Accusing BJP of adopting an ideology in which common man will be identified not by his capabilities and skills but by his religion, language and caste, she said, the saffron party’s ideology is of “hatred, narrow mindedness and consistent hunger to achieve power” at the centre.
“Their (BJP) ideology wants to take the country on that path where nation’s entire power wrests with one person,” she said in an indirect reference to Narendra Modi. “They will take the country to a situation where the poor, weak and farmers will beg for their rights,” she said.(

Unique style of garnering votes in Tamil Nadu are,

Offering Cheap country liquor, Biryani, a none veg delicacy free of cost.
Carting people to attend Party Public meetings in Lorries,Trucks, offering them Food, Liquor and Cash .
Visiting people at Home and offering them cash.
Falling at the feet of Elders and at times even children!
Then we have a motley group of Third front , which belongs to none of the groupings above and are awaiting the results to form a Coalition sans the Congress and BJP.
The Ruling Party is besieged with scams galore starting with Rs.i,86,000 Lakh crore 2 G Spectrum allotment in Telecom Sector,Helicopter Scam involving crores of Rupees,ISRO (Space Agency),Housing irregularities and many more.
Also there were instances of moral turpitude by the senior party members.
The economy , despite claims that the Macro economy is performing well, the price of essentials are shooting up.
There is a Prime Minister who wields no power but the Government is controlled by the leader of the Congress party, an Italian woman , the wife of Late Rajiv Gandhi, ex-Prime Minister of India.
The Family has been ruling India for three generations starting from Jawaharlal Nehru, through Indira Gandhi, his daughter and by her son Rajiv Gandhi.
Now the party has indicated that Rahul Gandhi, son of Rajiv and Sonia Gandhi as the Prime Ministerial Candidate.
The Opposition has announced Narendra Modi, the Chief Minister of Gujarat, of the BJP party.
Curiously India does not have a Presidential form of Government.
It has a Federal set up where the leader of the major party in the Elections outings ,shall form the Government!
The reason is that the opposition has no Policies different from the Ruling party.
But the BJP off and on plays the Hindu Card, claiming that the Hindus are not treated equally in what is essentially Hindu Country , with the Muslims.
The ruling Congress party plays the Muslim card .
And both the parties play the Caste Card regularly.
Even now, the candidates are selected based on the caste considerations, that is the candidate belonging to the caste of the Majority voters are selected.
Both the parties are equally shy of giving equal opportunities for women despite proclamations to the contrary.
On the security issues there is no difference between both the parties.
Or On the Economic Policies.
So each party is accusing the other of corruption .
While the Congress is harping on Stability factor , the BJP is calling the Congress as Corrupt.
Then the deciding factor will be the regional parties, who can decide the formation of the Government when the results are likely to be fragmented.
Though the opinion polls have revealed a high gain for BJP and the lowest ever seats for the Congress, no party, except the BJP shall get simple majority.
This would necessitate the support of the regional parties.
They shall go in for their pound of flesh in terms of Cabinet berths!
And they have their regional agenda which will be difficult to fulfil in a federal setup, ( the regional parties also know this,)
The major States that have more Lok Sabha seats,shall decide the formation of the Government are UP (80),West Bengal (42),Maharashtra(48),AP (420, Tamil Nadu,Bihar (40 each)
The Chief Minister of Tamil Nadu is nurturing the ambitions of becoming the Prime Minister if both the congress and BJP do not get simple majority.
And the Chief Minister of Bihar too has this ambition.
Therefore the result is likely to be , as of now, the BJP might get more seats way ahead of Congress , yet shall fall short of majority.
The Regional parties might play a vital role.
Yet the charisma of the BJP prime Ministerial candidate Narendra Modi might sweep the polls because of the inexperience of Rahul Gandhi who shoots himself in the mouth..
