    That the ISIS is a fundamentalist state,to state it mildly.

     

    The atrocities being committed by them are beyond one’s imagination.

     

    What pains me most is the mute reaction of the Islamic community.

    But I do not seem to have heard any thing so far.

     

    Or are they doing this job of condemning so publicly that none hears of it?

     

    If an obscure magazine which no one would have heard of otherwise, had published some innocuous remark or a Cartoon on Muhammad, from a country like Iceland,Norway, there would have been vociferous protests starting from Muslim Countries, down to our street Mullahs and Imams.

     

    Probably these people consider the atrocities as not worth noting!

     

    Now ISIS has issued a Pamphlet explaining the justification, nay a diktat, for Raping woman they have captured.

    “Question 1: What is al-sabi?

    “Al-Sabi is a woman from among ahl al-harb [the people of war] who has been captured by Muslims.

    “Question 2: What makes al-sabi permissible?

    “What makes al-sabi permissible [i.e., what makes it permissible to take such a woman captive] is [her] unbelief. Unbelieving [women] who were captured and brought into the abode of Islam are permissible to us, after the imam distributes them [among us].”

    “Question 3: Can all unbelieving women be taken captive?

    “There is no dispute among the scholars that it is permissible to capture unbelieving women [who are characterized by] original unbelief [kufr asli], such as thekitabiyat [women from among the People of the Book, i.e. Jews and Christians] and polytheists. However, [the scholars] are disputed over [the issue of] capturing apostate women. The consensus leans towards forbidding it, though some people of knowledge think it permissible. We [ISIS] lean towards accepting the consensus…”

    “Question 4: Is it permissible to have intercourse with a female captive?

    “It is permissible to have sexual intercourse with the female captive. Allah the almighty said: ‘[Successful are the believers] who guard their chastity, except from their wives or (the captives and slaves) that their right hands possess, for then they are free from blame [Koran 23:5-6]’…”

     “Question 5: Is it permissible to have intercourse with a female captive immediately after taking possession [of her]?

    “If she is a virgin, he [her master] can have intercourse with her immediately after taking possession of her. However, is she isn’t, her uterus must be purified [first]…”

    “Question 6: Is it permissible to sell a female captive?

    “It is permissible to buy, sell, or give as a gift female captives and slaves, for they are merely property, which can be disposed of [as long as that doesn’t cause [the Muslim ummah] any harm or damage.”

    “Question 7: Is it permissible to separate a mother from her children through [the act of] buying and selling?

    “It is not permissible to separate a mother from her prepubescent children through buying, selling or giving away [a captive or slave]. [But] it is permissible to separate them if the children are grown and mature.”

    “Question 8: If two or more [men] buy a female captive together, does she then become [sexually] permissible to each of them?

    “It is forbidden to have intercourse with a female captive if [the master] does not own her exclusively. One who owns [a captive] in partnership [with others] may not have sexual intercourse with her until the other [owners] sell or give him [their share].”

    “Question 9: If the female captive was impregnated by her owner, can he then sell her?

    “He can’t sell her if she becomes the mother of a child…”

    “Question 10: If a man dies, what is the law regarding the female captive he owned?

    “Female captives are distributed as part of his estate, just as all [other parts] of his estate [are distributed]. However, they may only provide services, not intercourse, if a father or [one of the] sons has already had intercourse with them, or if several [people] inherit them in partnership.”

    “Question 11: May a man have intercourse with the female slave of his wife?

    “A man may not have intercourse with the female slave of his wife, because [the slave] is owned by someone else.”

    “Question 12: May a man kiss the female slave of another, with the owner’s permission?

    “A man may not kiss the female slave of another, for kissing [involves] pleasure, and pleasure is prohibited unless [the man] owns [the slave] exclusively.”

    “Question 13: Is it permissible to have intercourse with a female slave who has not reached puberty?

    “It is permissible to have intercourse with the female slave who hasn’t reached puberty if she is fit for intercourse; however if she is not fit for intercourse, then it is enough to enjoy her without intercourse.”

    “Question 14: What private parts of the female slave’s body must be concealed during prayer?

    “Her private body parts [that must be concealed] during prayer are the same as those [that must be concealed] outside [prayer], and they [include] everything besides the head, neck, hands and feet.”

    “Question 15: May a female slave meet foreign men without wearing a hijab?

    “A female slave is allowed to expose her head, neck, hands, and feet in front of foreign men if fitna[enticement] can be avoided. However, if fitna is present, or of there is fear that it will occur, then it [i.e. exposing these body parts becomes] forbidden.”

    “Question 16: Can two sisters be taken together while taking slaves?

    “It is permissible to have two sisters, a female slave and her aunt [her father’s sister], or a female slave and her aunt [from her mother’s side]. But they cannot be together during intercourse, [and] whoever has intercourse with one of them cannot have intercourse with the other, due to the general [consensus] over the prohibition of this.”

    “Question 17: What is al-‘azl?

    Al-‘azl is refraining from ejaculating on a woman’s pudendum [i.e. coitus interruptus].”

    “Question 18: May a man use the al-‘azl [technique] with his female slave?

    “A man is allowed [to use] al-‘azl during intercourse with his female slave with or without her consent.”

    “Question 19: Is it permissible to beat a female slave?

    “It is permissible to beat the female slave as a [form of]darb ta’deeb [disciplinary beating], [but] it is forbidden to [use] darb al-takseer [literally, breaking beating], [darb] al-tashaffi [beating for the purpose of achieving gratification], or [darb] al-ta’dheeb [torture beating]. Further, it is forbidden to hit the face.”

    Question 20: What is the ruling regarding a female slave who runs away from her master?

    “A male or female slave’s running away [from their master] is among the gravest of sins…”

    “Question 21: What is the earthly punishment of a female slave who runs away from her master?

    “She [i.e. the female slave who runs away from her master] has no punishment according to the shari’a of Allah; however, she is [to be] reprimanded [in such a way that] deters others like her from escaping.”

    “Question 22: Is it permissible to marry a Muslim [slave] or a kitabiyya [i.e. Jewish or Christian] female slave?

    “It is impermissible for a free [man] to marry Muslim or kitabiyat female slaves, except for those [men] who feared to [commit] a sin, that is, the sin of fornication…”

    “Question 24: If a man marries a female slave who is owned by someone else, who is allowed to have intercourse with her?

    “A master is prohibited from having intercourse with his female slave who is married to someone else; instead, the master receives her service, [while] the husband [gets to] enjoy her [sexually].”

    “Question 25: Are the huddoud [Koranic punishments] applied to female slaves?

    “If a female slave committed what necessitated the enforcement of a hadd [on her], a hadd [is then] enforced on her – however, the hadd is reduced by half within the hudud that accepts reduction by half…”

    “Question 27: What is the reward for freeing a slave girl?

    “Allah the exalted said [in the Koran]: ‘And what can make you know what is [breaking through] the difficult pass [hell]? It is the freeing of a slave.’ And [the prophet Muhammad] said: ‘Whoever frees a believer Allah frees every organ of his body from hellfire.’

    How does one react to this?

    Background of the story:

    More than 2,500 Yazidi women have been captured by the hardline terrorist group, according to work carried out by a team of researchers from Bristol University’s Gender and Violence Research Centre. The team is led by Nazand Begikhani, an adviser to the Kurdistan regional government on gender issues,

    “These women have been treated like cattle,” she told CNN. “They have been subjected to physical and sexual violence, including systematic rape and sex slavery. They’ve been exposed in markets in Mosul and in Raqqa, Syria, carrying price tags.”

    Yazidi activists say that the number of women missing is closer to 4,600.

    According to the Middle East Media Research Institute, MEMRI, who translated the pamphlet, it was likely released in response to the public uproar about the kidnapping and treatment of the Yazidi women.

    In the pamphlet, titled Su’al wa-Jawab fi al-Sabi wa-Riqab (“Questions and Answers on Taking Captives and Slaves”), ISIS justifies capturing the women due to their unbelief in Islam. “Unbelieving [women] who were captured and brought into the abode of Islam are permissible to us.”

    This is an observation by a Lower Court in India and The Higher Court has taken objection to it!

    Is quoting a fact of Life condemnable?

    I would have understood this stricture coming from a Feminist Group,come to think of it, from a Woman, as if a woman does a favor to Men by indulging in sex and that women are least interested in Sex.

    Story:

    A man and woman, if left alone, will always go for sexual intercourse.” This is what a Kancheepuram judge said while awarding life imprisonment to a murder accused last year. The judge‘s loose comments have drawn the ire of the Madras high court, which not only acquitted the accused but also decried the judge for arriving at “judicial conclusions purely based on surmises and conjunctures.”

    In the March 13, 2012 order sentencing Kattu Raja, a factory watchman, for murdering a co-worker, the district and sessions judge-II of Kancheepuram had said: “A man and woman, if left alone, will always go for sexual intercourse. In this case, the accused and the deceased might have been left alone. At that time, the accused would have advanced sexual overtures towards the deceased. She might have refused. Still there might have been sexual intercourse between them. Again, the accused would have invited her for sexual intercourse, which she would have refused. This would have resulted in an ill-feeling.”

    The order was quoted by the HC division bench of Justice K N Basha and Justice S Nagamuthu while acquitting Raja of all charges on April 30. Flaying the sessions judge for such loose comments, the bench said: “These observations of the trial court are based merely on conjectures. It is not understood as to how the court could come to a judicial conclusion that a man and woman, if left alone, will always go for sexual intercourse.”

  • Rape Reforms, Complaint, Trial, Post-Delhi Gang Rape.

    Rape is a heinous crime that calls for a social rethink.

    The following points may be borne in mind.

     

    Procedure for lodging a Complaint.

     

    The procedure for Complaining about rape is just as in another case.

     

    You go to a Police Station, state  the case and get a First Information Report (FIR)

     

    As in other cases, there is jurisdictional red tape in accepting these complaints.

     

    This has to be made Jurisdiction Free and any Police Station must accept the case.

     

    Medical Test is now conducted, to be acceptable to the Court , is to be carried out by A Government Hospital.

     

    This procedure must change to enable Private Hospitals as well and all these Hospitals must have the  expertise and infrastructure to prepare the report.

     

    The Forensic Report must be complete within A week from the date of FIR.

     

    Trial

     

    Trials are long and tedious.

     

    To cut this short, no adjournments will be allowed in a Rape Case Trial.

     

    The Appeal time should be restricted to not more than 15 days.

     

    Initial Judgement must be delivered within 15 days from the Date of the  FIR with Forensic Report

     

    Punishment for the Rapists.

     

     

    It is normal to clamor for Death Sentence now, as we are too upset to think .

     

    The world is slowly doing away with death penalty .

     

    The punishment should be Life imprisonment, with no personal visits for the Culprit.

     

    Prevention of Rape.

     

    I have posted on the reasons for rape in India.

     

    The following points need elucidation.

     

    Just as one does not jay walk in the center of the Road, one must not go about in tempting clothes.

     

    Late night parties, Pub culture,Free outings with out some one who is related  or a close friend are some points worth noting.

     

    Freedom brings on Responsibility and an awareness of danger.

     

    Men and women must understand the basic nature of instincts, that of Sex and unless one is guarded one’s Life will be ruined.

     

    A note of caution.

     

    It is not ways true that all Rape complaints are genuine.

     

    As in Dowry cases the law may be used to settle scores.

     

    The circumstantial evidence must be examined carefully and the back ground of the man/woman must be examined thoroughly.

     

    We also have ‘Consensual  intercourse’ which is tricky;one can have it and later call it a Rape.

     

    This could happen in  married case also.

     

    To minimize the risk, a time frame of 72 hours must be  fixed for reporting a crime.

     

    Important of all is that you have your whole Life ahead of you and simply a moment sexual enjoyment.

     

    The highlights of the Bill include substituting sections 375, 376, 376A and 376B by replacing the existing sections 375, 376, 376A, 376B, 376C and 376D of the Indian Penal Code,1860, replacing the word `rape’ wherever it occurs by the words `sexual assault`, to make the offence of sexual assault gender neutral, and also widening the scope of the offence sexual assault.

    The punishment for sexual assault will be for a minimum of seven years which may extend to imprisonment for life and also fine for aggravated sexual assault, i.e., by a police officer within his jurisdiction or a public servant / manager or person talking advantage of his position of authority etc. The punishment will be rigorous imprisonment which shall not be less than ten years which may extend to life imprisonment and also fine.

    The age of consent has been raised from 16 years to 18 years in sexual assault. However, it is proposed that the sexual intercourse by a man with own wife being under sixteen years of age is not sexual assault. Provision for enhancement of punishment under sections 354 and 509 of IPC and insertion of sections 326A and 326B in the IPC for making acid attack a specific offence have been made….

    Any man who with a sexual purpose, touches, directly
    or indirectly, with a part of the body or with an object, any part of the body of a
    woman, without the consent of such woman, shall be punished with simple

    Provided that, if the man is related to the woman, he shall be punished with
    imprisonment of either description for a term which may extend to 7 years and with fine”.
    2(a) Whoever, with a sexual purpose, touches, directly or indirectly, with a part of
    the body or with an object any part of the body of a minor, or
    (b) Whoever, with a Sexual purpose, invites, counsels or incites a minor to touch,
    directly or indirectly, with a part of the body or with an object, the body of any
    person, including the body of the person who so invites, counsels or incites or
    the body of the minor.
    Shall be punished with imprisonment of either description which may extend to five
    years and shall also be liable to fine.
    (3) Whoever being in a position of trust or authority towards a minor or being a
    person with whom the minor is in a relationship of dependency,
    (a) touches, directly or indirectly, with a sexual purpose, with a part of the body or
    with an object, any part of the body of such minor or
    (b) With a sexual purpose, invites, counsels or incites a minor to touch, directly or
    indirectly, with a part of the body or with an object, the body of any person,
    including the body of the person who so invites, counsels or incites or the
    body of the minor…

    The proposed section 53A shall read as follows:
    “53A.(1) When a person accused of any of the offences under sections 376, 376A, 376B,
    376C, 376D or 377 or of an attempt to commit any of the said offences, is
    arrested and an examination of his/her person is to be made under this section,
    he/she shall be sent without delay to the registered medical practitioner by
    whom he/she is to be examined.
    (2) The registered medical practitioner conducting such examination shall without
    delay examine such person and prepare a report specifically recording the
    result of his examination and giving the following particulars:

    (i) the name and address of the accused and the person by whom he was
    brought,
    (ii) the age of the accused,
    (iii) marks of injury, if any, on the person of the accused, and (iv)Other
    material particulars in reasonable detail.
    (3) The report shall state precisely the reasons for each conclusion arrived at.

    (4) The exact time of commencement and completion of the examination shall
    also be noted in the report, and the registered medical practitioner shall,
    without delay, forward the report to the investigating officer, who shall forward
    it to the Magistrate referred to in section 173 as part of the documents referred
    to in clause (a) of sub-section (5) of that section.”

    “375. Sexual Assault: Sexual assault means –
    (a) The introduction (to any extent) by a man of his penis, into the vagina
    (which term shall include the labia majora), the anus or urethra or
    mouth of any woman or child–
    (b) the introduction to any extent by a man of an object or a part of the
    body (other than the penis) into the vagina(which term shall include the
    labia majora) or anus or urethra of a woman
    (c) the introduction to any extent by a person of an object or a part of the
    body (other than the penis) into the vagina(which term shall include the
    labia majora) or anus or urethra of a child.
    (d) manipulating any part of the body of a child so as to cause penetration
    of the vagina (which term shall include labia majora) anus or the
    urethra of the offender by any part of the child’s body;
    In circumstances falling under any of the six following descriptions:
    Firstly – Against the complainant’s will.
    Secondly – Without the complainant’s consent.
    Thirdly – With the complainant’s consent when such consent has
    been obtained by putting her or any person in whom the
    complainant is interested, in fear of death or hurt.
    Fourthly – With the complainant’s consent, when the man knows that
    he is not the husband of such complainant and that the
    complainant’s consent is given because the complainant believes that the offender is another man to whom the

    “Myth: Rape is caused by lust or uncontrollable sexual urges and the need for sexual gratification.

     

    Fact: Rape is an act of physical violence and domination that is not motivated by sexual gratification.

     

    Myth: Once a man gets sexually aroused, he can’t just stop.

     

    Fact: Men do not physically need to have sex after becoming sexually excited. Moreover, they are still able to control themselves after becoming aroused.

     

    Myth: Women often lie about rape or falsely accuse someone of rape.

     

    Fact: Statistical studies indicate false reports make up two percent or less of the reported cases of sexual assault. This figure is approximately the same for other types of crimes.
