On March 7th 2008, he was arrested by the Terrorism Investigation Division of the Sri Lanka Police, held for 6 months without charge and finally sentenced to 20 years hard labor. Due to the international outcry over the ethnic cleansing undertaken on the island by the Rajapaksa regime, and his sentence being overturned at the court of appeal, he was released on 11th January 2010. In a move typical of the public relations element of the Rajapaksa government, the journalist was then pardoned by Rajapaksa on May 3rd 2010.

    In this typical scene witnessed regularly throughout history, large migrations of civilians are seen fleeing nationalist violence in a desperate attempt to escape death. This type of migration had been a pre-planned element in the Rajapaksa nationalist doctrine and came about as a direct result of an upswing in military weapons supply and financial funding from China and the United States.

    Since Sri Lanka gained independence from Britain in 1948, relations between the majority Sinhalese and minority Tamil communities have been strained. Rising ethnic and political tensions, along with ethnic riots and pogroms in 1956, 1958, 1977, 1981 and 1983, led to the formation and strengthening of militant groups advocating independence for Tamils. The ensuing Sri Lankan Civil War has resulted in the deaths of more than 70,000 people and the forced disappearance of thousands of others.

    One-third of Sri Lankan Tamils now live outside Sri Lanka. While there was significant migration during the British colonial period, the civil war that began in 1983 led to more than 800,000 Tamils being forced from their homes within Sri Lanka, and many have left the country for destinations such as Canada, India and Europe.

    Estimates varying from less than 10000,[16] to 40,000 Sri Lankan Tamils were reportedly killed in the final weeks of the military victory over Tamil rebels in 2009 as the Tamil Tigers took Tamil civilians as human shields, according to the UN,[17] but the end of the civil war has not improved conditions in Sri Lanka,[18] with press freedom not being restored[19] and judiciary coming under political control.[20] Sri Lankan Tamils continue to seek refuge in countries like Canada and Australia.[21][22] The International Organisation for Migration and the Australian government have declared Tamil refugees as economic migrants.[23] Canada has tightened controls on their refugee program due to various abuses within the Canadian refugee system..[24] A Canadian government survey found that over 70% of Sri Lankan Tamil refugees have gone back to Sri Lanka for holidays raising concerns over the legitimacy of their refugee claims.[25](Wiki)

    Despite denials the evidence is there for every one to see from Politicians , Bureaucrats and people on the ground.

    As the policy of ethnic cleansing came to its logical military conclusion, Tamils found themselves locked into concentration camps on the island and subject to sexual violence and organised abuse by prison guards. Only through the international public community were some of these people eventually allowed to leave, many having gone into crippling poverty.

    The rhetoric of extremism in the globalised security environment that now exists is surprisingly malformed, and equally surprisingly influential. In Sri Lanka, the operation to bring about the ethnic cleansing of the Tamils was initially formed around a humanitarian interventionist pole8 alongside a domestic security intention. This initial rhetoric was criticised at the time as being ‘unlikely’ but due to the globalised posture of governments and media around the world in the post 9/11 event phase, the narrative unusually succeeded in its efforts.

    In the 2008 video below, this rhetoric can be seen with a BBC interview carried out with a Sri Lankan government employee, Prof. Rajiva Wijesinha [Secretariat for Coordinating the Peace Process (SCOPP)]. In this interview, the scope of the nationalist policy against the Tamils can be seen in its formation alongside the belligerence of the British Broadcasting Corporation as it existed at the time.

    Proof.

    In this second interview again for the BBC conducted in 2011 after the full weight of the ethnic cleansing had become known across the world, Prof. Rajiva Wijesinha in his capacity as government coordinator of the peace process, routinely defaults to defending the nationalist regime of Rajapaksa in Sri Lanka and further continues to disrupt and retard the interviewers questioning about the massacre in Sri Lanka. He calls into question the motives of the ‘human rights industry’, disambiguates unambiguous questioning given by the interviewer, persistently derails and deviates away from line of enquiry and promotes and demotes salient information in order to evade complicity. This approach is almost identical to his motif in the first interview and reveals persuasive evidence of government rhetoric taking on academic form.

    Evasion

    For many around the world, the efficacy of international law is far from straightforward and given to inherent subjectivity. In an age in which human rights abuses abound throughout all the political environments of the world, justice for those who have been subject to ethnic violence is a long and arduous process with varying chance of realistic success. No matter what weight of evidence exists, no matter how clean the case for prosecution, no matter how ‘persuasive’ the charge given that evidence, international law for many abruptly halts when in collision with the largest of its sponsors. This is undoubtedly true.

    For those in Rajapaksa’s regime, international law is a relative device that can be evaded, but only with considerable prior planning and foresight. For the most part, the personal ideology of Rajapaksa in the form of his own strident nationalism has simply arrived at an end point having reached its logical conclusion. There is evidence that Rajapaksa has been a long-time advocate10of nationalist ideology and his appearance at this point in time simply denotes a man who has seen his time come. It is here, that the fundamental nature of the war against the non-state actor, also known as the so called ‘War on Terror’ is revealed for what it is, a liberation for the tyrant…and a prison for his fool.

    The rhetoric now engaged in by the Rajapaksa nationalists is one in which considerable faith has been placed in the United States, China and India. These three actors constitute the vast bulk of delegates to the United Nations and hold most influence at the International Criminal Court [ICC]. Rajapaksa and his brother Lieutenant Colonel Nandasena Gotabaya Rajapaksa, have clearly made a calculated appraisal about their fortunes in relation to these three nations and have clearly concluded that Sri Lanka’s geo-strategic political position will successfully renovate international public opinion leading to a general failure of accountability at the UN.

    Sri Lanka cleverly played the East and North divide of Sri Lanka and Muslims and People working in Estates to ensure that the Tamils remain undivided.

    As its wont, The Tamils succumbed to it and they engaged in internecine war among themselves.

    Now the World, including the UN is being jolted by the proposed release of the Documentary ‘No Fire  Zone’, documentary unveiling the Genocide  of the Tamils, the cold-blooded murder of LTTE Chief’s son 12-year-old  Balachandran Prabhakaran, Sri Lanka,on the sly is going about the job of killing the Tamils in the Eastern Part of Sri Lanka,

    Sinhala militarisation, genocide in East goes unnoticed, unaccounted
    [TamilNet, Sunday, 17 February 2013, 10:51 GMT]In the name of a Sinhala-titled programme ‘Divineguma,’ Colombo intensively spearheads structural genocide of Eezham Tamils in the East. It has now gone to the extent of mushrooming Sinhala military camps and settlements running grocery shops and restaurants to the public. The only major construction activity in the East is the construction of Sinhala military camps. By talking only of the North and leaving out the East, the visiting foreign dignitaries buttressing State in the island systematically obscure what is happening in the East and imply that the annihilation of the nation of Eezham Tamils in the East is ‘normal and acceptable’. The line of subversion started when Mr. Robert Blake was the US ambassador in Colombo after the SL military capture of the East from the LTTE, and the line was later taken up by the Indians, political activists in the East said

    .Failure to internationally highlight and fight against what is happening in the East would first reflect in Vanni as what is happening there now and would eventually result in the annihilation of the Tamil nation in Jaffna itself, the activists in the East cited.

    The Tamil–Muslim discourse in the East has adversely affected the entire liberation question of the Tamil-speaking people in the island in the past and both the communities especially in the East have to keep that in mind in their deliberations, the activists said, adding that only a secular an independent State for the Tamil speakers in the island would ensure the life of self respect to all of them in the island.

    Meanwhile, even retail trade in the Ampaa’rai district has been taken over by the occupying Sinhala military, political sources said.

    Two major SL military camps have been created at Naavithan-ve’li and Anna-malai in Ampaa’rai district, where the SL military is now running grocery shops and restaurants to the public.

    At Annamalai, a building belonging to the irrigation department located amidst schools, hospital and other SL government departments, has been taken over by the SL military for its camp within the last one and a half months. The building was earlier occupied by the STF.

    Similarly, an extensive Sinhala military camp and training ground are in the making at a land that was earlier allocated for the construction of a broadcasting station for the Ampaa’rai district.

    Many other SL military camps are now being constructed at places such as the locality of the old hospital at Periya-neelaava’nai, Beach Road at Kalmunai, Thiruk-koayil, Aalaiyadi-vempu and at the tourist locality at Ullai.

    The camps terrorise especially the Tamil villages. While many Tamil villages erased out by the SL military during the war are yet to be resettled, Colombo is interested only in constructing military camps.

    Tamil politicians cited the examples of the villages at Kagnchi-kudichchaan-aa’ru and at Thangka-vealaayutha-puram.

    The politicians accused that Tamil areas are deliberately neglected in any development activity and Tamil politicians are never consulted on anything.

    They accused the Muslim polity in Ampaa’rai for blocking development of Tamil villages and for following a policy of land grab, marginalisation of Tamil polity and complete annihilation of the presence of Tamils in the district, in collaboration with the occupying Sinhala military.’

  • US Report on Genocide in Sri Lanka,Indicts LTTE and Government

    It is obvious that both LTTE and the Government of Sri Lanka were equally engaged in inhuman practices.

    While the one,LTTE,is reported to have been wiped out(claimed by the Sri Lankan Government),The Government is going scot-free.

    It has to be punished by the International Community.

    Report:

    The following allegations with respect to children and armed conflict during
    the reporting period have been reported:
    February 16 – An organization reported that the LTTE was attempting to
    recruit by force all boys and girls aged 14 years or older in the LTTEcontrolled territory.

    February 23 – Several organizations reported to Embassy Colombo that their
    sources reported ongoing LTTE forced recruitment of children. Another
    source stated that a young person who resisted being forcibly recruited had
    both his arms broken by the LTTE as punishment.
    March 3 – An organization received a report from a source in the NFZ that
    the LTTE was recruiting children as young as 12-years-old.
    March 7 – An organization reported that a source in Mullaittivu witnessed
    the LTTE abduction of children ages 12 to 16. The source saw the LTTE
    marching many children away.
    March 16 – An organization’s source in Mullaittivu reported that those
    recruited by the LTTE included male and female children as young as 14.
    March 17 – A Human Rights Watch (HRW) source in the Vanni reported
    that an angry mob formed following the death of two children caused by an
    LTTE recruitment unit. In a similar story, the nationalist daily newspaper
    Island reported that LTTE cadres shot the parents of a child whom they
    made an abortive bid to abduct, and then shot the child. This incident
    sparked violent protests by the civilians, who forced the cadres to retreat.
    Embassy Colombo noted that this report is consistent with earlier
    information regarding retaliation against the LTTE by civilians in the NFZ.
    March 18 – A source who escaped the conflict zone reported that anyone
    aged 12 or older was eligible for forced labor and recruitment by the LTTE.
    March 21-24 – HRW sources in the conflict zone reported that the LTTE
    rounded up over 400 youths who had sought refuge in Valaiganar Catholic
    Church, and immediately took the children to training camps by bus. A
    similar account was reported by another organization’s local source on
    March 23; this source estimated the number of youths taken at over 250.
    March 23 – An organization received a report from a local source that the
    LTTE was recruiting children aged 12.
    March 23 – Organizations with sources in the conflict zone provided to
    Embassy Colombo some details on communications from the NFZ,
    including reports that the LTTE forcibly recruited individuals, including
    children, and killed those who resisted orders. They noted that for the
    LTTE, ―age is not an issue anymore for recruitment/building defenses.‖[13]
    Report to Congress on Incidents During the Recent Conflict in Sri Lanka
    March – A source reported that the LTTE forcibly recruited people
    regardless of gender or age, including those in their early teens. …….

    A number of sources alleged that the GSL committed unlawful killings.
    There is video footage showing purported evidence of GSL soldiers killing captive
    Tamils in January. Separately, multiple reports alleged that in the final few days of
    fighting, between May 14 and May 18, senior LTTE leaders contacted
    international representatives via satellite phone in an effort to broker a surrender
    but were killed after they allegedly reached a surrender agreement with the GSL.
    As reflected in common article 3 of the Geneva Conventions, IHL prohibits
    all violence to life and person, including murder, of armed forces who have laid
    down their arms or are in detention.
    The following allegations of killing of captives or combatants seeking to
    surrender have been reported:
    January – In late August an organization received a video clip from January
    which allegedly showed the summary execution of nine bound and naked
    Tamils by SLA soldiers. The video was supposedly filmed by a soldier
    present at the scene. Since the video’s release, the GSL has analyzed the
    clip and issued a statement identifying specific aspects of the video which it
    claims proved it to be forged. However, there has been no independent
    analysis of the footage.
    February 1 – An organization received reports from local sources that young
    men who managed to reach the government-established safe zones with their
    families were being picked up by the military; their bodies were found
    several days later. The organization opined that with no international or
    independent third party presence in the camps, the military was able to act
    with impunity, which was a reason why Tamil civilians were afraid to move
    to government-controlled areas.
    May 14-18 – An organization reported information from its sources that ―all
    the LTTE persons remaining in the NFZ were massacred.‖ The GSL
    maintains that these senior LTTE leaders in fact did not raise white flags or
    give any indication to the SLA soldiers in their vicinity that they intended to
    surrender, but instead continued fighting and were subsequently killed in the
    ensuing final battle.
    May 18 – Embassy Colombo, as well as press and foreign governments,
    received reports that LTTE political leaders Nadesan and Puleedevan, along
    with other LTTE leaders, were killed while surrendering to GSL forces……

    The GSL pledged to provide sufficient food and medical supplies to people
    in IDP camps and to those people still trapped in the NFZ. On February 17, the
    Senior Presidential Advisor announced a commitment to provide 80-100 metric
    tons (MT) of food per day to civilians, and that medicine would be included in the
    next shipment of supplies. In early March the GSL Presidential Secretariat issued
    a statement saying that there had been no case of any citizen in the north of Sri
    Lanka dying from starvation and that the GSL would take all measures to prevent
    such a tragic occurrence.

    Later that month the Minister of Health Care and
    Nutrition stated that the GSL continued to send enough medical and essential food
    supplies and ―won’t stop sending medical and food supplies‖ despite the possibility
    that the LTTE was confiscating supplies for its own cadres.

    However, while some incidents reported in this section cite deliveries of up
    to 500 MT of foodstuffs to the NFZ, the majority point to significant gaps between
    food, medicine, and clean water needs and the available supplies in the NFZ and
    IDP camps. These reports include instances of severe food shortages, malnutrition,
    particularly among the very young and old, as well as surgeries being performed
    with little or no anesthetic. (See Appendix A, photo 9.)

    Story:
    Embassies in Sri Lanka have expressed dismay over an “intimidating” protest which has blockaded the United Nations compound in the capital.

    Hundreds of people are demonstrating against a UN panel investigating alleged war crimes in Sri Lanka.

    Diplomatic missions including those of the UK, US and Germany said blocking access to the UN and “intimidating” its workers breached “international norms”.

    There were chaotic scenes outside the UN offices as police were called in.

    Ten embassies in the capital, Colombo, issued a joint statement on Saturday condemning the protests, which they said would harm Sri Lanka’s reputation on the international stage.

    In the statement, they called upon the Sri Lankan government to take “all appropriate steps” to ensure the safety of the UN compound and staff.
    War crimes allegations

    The latest escalation comes a day after the UN Secretary-General, Ban Ki-moon, urged Sri Lanka to “normalise conditions” around the UN office in Colombo after days of angry demonstrations.

    On Thursday, Mr Ban recalled his top envoy to the island, Neil Buhne, and closed a regional office in Colombo.

    Most UN staff managed to leave the compound after police tried to break the blockade in Colombo on Tuesday, before they too were ordered to leave by the government.

    Several senior staff, however, remained inside and the protests, led by a government minister, were continuing.
