There seems to a be well planned strategy behind Raja and Kanimozhi declaring in the Court that the PM , the Home Minister P.Chidambaram and the telecom minister decided that the licenses for the 2G spectrum were not to be auctioned.
This would force the PM and the Home Minister appear as witnesses in the case.
“I am showing you (judge) the minutes of the meeting in which the prime minister, the then finance minister and the telecom minister decided that the licences for the 2G spectrum was not to be sold/auctioned,” said Kanimozhi’s senior advocate Sushil Kumar to the Special CBI Judge, OP Saini.’

They would not be able to defend their position that they knew nothing of this, especially in view of the fact that there were’ Non paper decisions’ as indicated by the Finance Ministry note to JPC.( is Kanimozhi referring to these minutes, which are kept and disappeared to enable Finance Ministry to Declare ‘Non paper decisions’?
Added to this is the Public Statement of Kabil Sibal that there is no loss to the Public exchequer in allocating Licenses in 2 G Spectrum.
More importantly the Government and the Congress have lied to the people that they would go after the irregularities in 2G , all the while maintaining that the decisions in respect of 2 G were taken away from GoM and also from the ambit of PMO as well as Finance Ministry’s suggestions were ignored.
Documents prove otherwise.
Reason for my observation is the

By quoting the Affidavit. Raja can now declare that they had nothing to do with the scam, especially if there is no loss incurred in allotment of the 2G ,they had no motive in performing the actions he did.
How far this will help Kanimozhi is open to debate as the case about her does not relate to 2G scam directly but receipt of unexplained money of 200 Crores to her company.
Ridiculous it is for Kanimozhi to claim that she had no idea as to what happened in Kalaignar TV as she was not involved in the day-to-day affairs of the company and that she has attended only two Board meetings.
This is not legally valid.
The disclosure in the Affidavit clearly shows that the PM was in the know of things in 2 G License allocation and it also lends credence to the claims of Raja that he was following the Policies of the Government and that the PM has approved his decisions.
However he can not escape on jumping the queue by the Corporates, laying down impossible time frame to submit tenders, his manipulations with Radia and the money trail.
The issue seems to have moved to Congress’s Court.
