    If ever there was an interview where the interviewed huffed, Hawed, Ducked slipped ,tied himself in knots and landed with egg all over, I would rate Rahul Gandhi‘s Interview with Arnob Gosawmi of TimesNow News Channel on 27 January at 9 pm in Newhour.

    If Karan Thapar was nailed black and blue by Jayalalithaa when he interviews her, when she bluntly told him that she did not like the way he conducted the Interview and tht it definitely was not a pleasure for her to interact with hi,

    Now Arnob Gosawmi fired bullets after bullets to Rahul Gandhi and he was left with no clue at all.

    On the issue of Gujarat Riots,when Gosawmi asked him the rationale behind Congress attacking Narendra Modi after the Courts had given Modi a clean chit in the Gujarat Riot case, all Rahul could say was, totally irrelevant of course, that the Congress believed in Empowerment of women, taking democracy to grass-roots and about the six Bills pending in the parliament to root out corruption!

    I counted the number of times Gosawmi asked Rahul about Modi.

    Six times and he got the same answer.

    Then Arnab switched over to the  killing of  the Sikhs after the assassination of Indira Gandhi in 1984.

    Reference was also made to Rahul Gandhi’s speech about his controlling his anger at his grandmother’s killing.

    Asked why the Congress did not take any action against Jagdish Tytler,HKL Bhagat and others for inciting the violence against the Sikhs, all Rahul could say he wanted law to take its own course.

    When reminded that the same people were to be given tickets and were denied after media uproar Rahul went into Empowerment story!

    On corruption, more specifically on Ashok chavan (and Adarsh Scam )as to why no action was taken against him ,action was taken against only against the bureaucrats when the Judicial enquiry indicted all, including the politicians,Rahul Gandhi went into sermonizing about the system being corrupt and the need to change it!

    Then again on Congress’s position on bringing th Political Parties under RTI, Rahul wanted the Bills in Parliament passed, all apries must agree to this.

    He added that if one wants to include the political parties, Judiciary and Media should also be included.

    When Arnab pointed out neither the Judiciary nor the media run the Government, Rahul ran away from the argument.

    The hilarious point he made was that the law makers, meaning MLAs do not know how to make Laws in UP.!

    As though Congress is the only Literate Party.

    At this point I changed the channel.

    Even if  the congress wins power, Rahul Gandhi will definitely make an ass of a Prime Minister, who roams in abstract theory and no practical sense or determination.

    Unless the BJP decides to commit suicide, which it normally does, congress will lose the election.

    Arnab: Because I like and enjoy being a journalist, it is a professional challenge for me. My question is you avoiding a direct face-off with Mr. Narendra Modi?

    Rahul: I am going to answer the question but I just want to ask you, when you were young and thought of being a journalist what drove you?

    Arnab: Once I decided to become a journalist, I can’t be half a journalist. Once you have decided to get into politics and you are leading your party effectively, you can’t be leading your party by half, so I’ll throw the question, with respect, back to you, Narendra Modi is challenging you on a daily basis?

    Rahul: You are not answering my question, but I will answer the question and that will give you some insight into how Rahul Gandhi thinks. For that I will have to expand a little bit about my growing up, how I grew up and the circumstances in which I grew up. What I saw when I was a child ,was my father, who was a pilot, and because of circumstances was thrown into the political system and all I saw when was small after my grandmother died was my father in constant-constant combat with the system in India and then I saw him die actually.

    In my life I have seen my grandmother die, I have seen my father die, I have seen my grandmother go to jail and I have actually been through a tremendous amount of pain as a child when these things happen to you, what I had to scared  off I lost, there is absolutely nothing I am scared off. I have an aim, I have a clear aim in my mind and the aim is that I do not like what I see in Indian politics, it is something that is inside my heart. It is like in our mythology when they talk about Arjun, he only sees one thing, he does not see anything else, you asked me about Mr. Modi you ask me about anything and the thing that I see is that the system in this country needs to change, I don’t see anything else and I am blind to everything else. I am blind because I saw people I love destroyed by the system. ”

    If one reads the information closely, the Pawar scam and the allocation of Coal Blocks to Jayaswal, the connection of Thackeray Group  and the stunning silence of BJP on Gadkari scam and his connection to irrigation fraud, we can notice that all are in cahoots, irrespective of party affiliations.

    ‘Few days ago, the city observed builder Lalit Gandhi’s second death anniversary. Gandhi, co-founder of Lok Group, passed away on 23 March 2010.

     

    He had seen visions of innovatively making money from the dilapidated ceased buildings of Chira Bazaar in South Mumbai. In 2006-07, he founded an NGO called Remaking of Mumbai Federation (ROMF).

     

    This NGO was spearheaded by Mayank Gandhi, Shri Lalit Gandhi’s charismatic nephew (who went on to achieve national fame last year as a major architect of Anna Hazare’s India Against Corruption campaign).

    By fudging the lines of demarcation between commercial interest, private interest and public interest, this NGO merged Lok Group’s commercial interest with the ambition of over 8000 tenants living in dilapidated buildings to have better homes.

    By connecting with the Mumbaikar’s desire for a beautiful city, Remaking of Mumbai Federation (ROMF) became a media-darling and messiah of Chira Bazaar Cluster Development. It organized several events.

     

    Around the core of these events, a publicity campaign consisting of systematic misinformation and name-dropping was built. Sri Sri Ravishankar, Justice P N Bhagwati, Narayan Murthy and Deepak Parekh,

     

    Citispace are a small sample of the dignitaries whose names were exploited for creating brand-equity around ‘Remaking of Mumbai’. The credits-list of this newsletter is a good specimen of such name-dropping.

    Contrary to the public perception that was created, there was nothing “inclusive” about Remaking of Mumbai Federation.

    It was never a true federation of stakeholders, and it never gained the grassroots level support from landlords and tenants of Chira Bazar. The couple of tenants associations supposedly supporting ROMF were little more than letterheads.

    To Lalit Gandhi’s Lok Group-the owner of this NGO-Chira Bazaar Cluster Development was a cash cow to be carved up into beef and sold to the highest bidder. Had things gone according to plan, Lok Group might have reaped bumper profits by selling it for at least Rs 37.5 crores, if not much more.

    Under the heading, ‘Cancellation of earlier MOUs and Agreements’, this document refers to an earlier transaction worth Rs 37.5 crore in August 2010, in post-dated cheques dated from November 2010 till end-2013.

     

    ROMF had claimed that it would deliver the Chira Bazaar cluster development project, tied up neatly, to Unity Developers. (Unity Infraprojects Limited (UIL) is the holding Company of Unity Realty & Developers Ltd – the buyer of this project.

     

    The promoters of UIL- K K Avarsekar and his associates – are known to have the blessings of the Thackeray family; this may explain the eagerness of MCGM’s High Powered Committee to overlook the glaring shortcomings of this project.)

     

    So, in effect, this present agreement, which scaled down the payment to Rs 10 crore, was an admission of ROMF’s inability to deliver as promised.

     

    As per the present agreement made in Jan 2011, Lok Group and ROMF sold a 5 acre “pilot project” carved out of this 30-acre project to Unity Realty & Development Ltd (URDL) for down-payment of Rs 5 crore, plus Rs 5 crore linked to the project progress.

     

    Under the heading, ‘Monetary Obligations & Considerations’. (Incidentally, this deal was transacted on stamp paper of Rs 100.

     

    Stamp duty of 5% of value of immovable properties / land / development rights was not paid on this Development Agreement.

     

     

    If we take the deal at its face value – Rs 10 crore – it amounts to stamp duty evasion of about Rs 50 lakh.

     

    But some experts feel that the true value of this agreement is far beyond these figures; even under the scaled-down agreement, ROMF was delivering to Unity Realty an intangible asset worth hundreds of crores. One way or another, it is a huge evasion, and Maharashtra Stamp Duty department should estimate what its true value is!)

    In this agreement, the seller is ROMHIF. So what is the connection of ROMHIF with ROMF?

     

    This extract from Lok Housing & Constructions Ltd Directors Report 2010 explains it: “Remaking of Mumbai Housing Infrastructure & Finance Ltd” (ROMHIF) submits proposal for Chira Bazaar Cluster redevelopment in C Ward of Mumbai.

     

    The High Powered Committee clears Chira Bazaar Cluster redevelopment proposal of ROMHIF to redevelop around 30 acres of land (362 buildings and over 8000 tenements).

     

    The proposal for demolishing of old and dilapidated structures and construction of high rise buildings is under consideration with Government of Maharashtra.

     

    ROMHIF has submitted its proposal to redevelop around 30 acres of land (362 buildings and over 8000 tenements) in the Kalbadevi-Chira Bazar area in C Ward. It proposes to demolish these old and dilapidated buildings and in their place construct high rise structure in the ear-marked plots.

     

    Lok Housing Ltd has 49% stake in the shareholding of Remaking of Mumbai Development Ltd. (ROMD) which is the holding Company for ROMHIF”. As per the website of Registrar of Companies, the registered Addresses of both ROMD and ROMHIF is Lok Bhavan,

     

    Andheri East, Mumbai. Paid up capital of ROMD and ROMHIF is Rs 40 lakh and Rs 5 crore respectively.

     

    Since Lok Housing Ltd as per Directors Report has 49% stake in the holding company ROMD for ROMHIF, who owns the balance 51% stake?

     

    Is it somebody in the government or civic administration?

     

    We don’t know, but it will be interesting to find out.

     

    The names of all companies start with Remaking of Mumbai.

     

    Why? So that the brand equity of ‘Remaking of Mumbai’ can be effortlessly passed on to any buyer. The government approvals gotten by ROMF can also be transferred, with some help from pliant government officials, to another entity with the same name, namely Remaking of Mumbai Unity Developers Private Limited. In this crucial clause, the agreement recognizes that it is crucial to retain the ‘Remaking of Mumbai’ name at all times, even if the latter part of the name were changed in future i.e. if Unity Realty & Developers sold its stake to someone else. (Now that is like saying: Smita is married to Ramesh. It is crucial that any man desirous of sleeping with Smita must knock on the bedroom door and say, “Open the door, I am Ramesh.” Needless to say, the real Ramesh gets paid.)

    Unfortunately for Lok Group and their buyer, Unity Realty, the state government questioned the fraudulent claims of Lok Group/ROMF – especially the claim that that it had written consent from 79.2% tenants. What it actually had was some letters from a small number of tenants, giving the project their best wishes without even knowing the particulars of the project – and of course, without knowing even which builder was going to undertake the massive redevelopment, and whether he had the capital and infrastructural capabilities to do so.

    Recently, Kerala chief minister Ooman Chandy created history by initiating 24-hour live webcast of his official chamber in Kerala. The idea has been widely accepted by Keralites worldwide and the webcast has received huge response from every corner of the world. In just three months, it has registered about 4 lac visitors.

    Impressed by Chandy’s move, Karnataka CM Sadananda Gowda has also planned a similar move in his Vidhana Soudha office and residence office at Krishna. But the difference is, Gowda’s office can be watched live only when he is available in office, but rest of the time, it will be offline. However, Chandy’s office is on camera for 24-hours.

    Speaking to Daijiworld over the phone, Sadananda Gowda said that impressed by Kerala CM’s initiative, he too wanted to bring transparency in his office. People in the state and Kannadigas who resides abroad have the right to see what’s happening in the CM’s office, he said, adding that he has already given the work to Kerala State agency, Centre for Development of Imaging Technology (C-DIT), to implement the technology. “There will be two cameras in Vidhana Soudha office and three in Krishna. People can watch what my officers and I are doing.”

    He appreciated the work done by daijiworld and requested that since daijiworld is the most popular website for Kannadigas worldwide, it should give a link to the live webcast on the site.

    The live webcast is expected to be installed by the end of this month or early December. There will be a formal inauguration of the event soon after the completion of installation.

    Dinakaran should have made the Judiciary hang its head in shame.But..no.SC and CJI are hiding behind legal mumbo jumbo, obscuring the issue.If th SC found him unfit to be chosen for SC as a Judge, how come he is allowed to continue as Justice in Karnataka?Is it that if you are not qualified enough to be recommended to SC, you are qualified to become CJ in a State.No reasons have been given for this funny stand.Now SC rules that no reason need be given for Judgments under RTI.This is precisely the reason that RTI must include judges’ reasons for a particular judgement.

    The moral authority of the Chief Justice of India “is of no value or significance” if he cannot make an “erring judge” fall in line – this is the view of Justice D.V. Shylendra Kumar of the Karnataka High Court.
    The “erring judge” in this case, though not named, is the chief justice of the Karnataka High Court, Justice P.D. Dinakaran, who is facing corruption charges.
    The comments by Justice Kumar on his blog have raised important questions.
    Top jurists say that issues unheard of in the higher judiciary – corruption, indiscipline, caste bias, etc – are the main reasons behind such airing of views.
    However, opinion is divided on the extent to which a serving judge should exercise his freedom of expression – the way Justice Kumar has done.
    Justice Kumar had in another context said a majority of judges were in favour of making their wealth details public. This led to a voluntary disclosure of wealth by Supreme Court judges.
    Now he wants Justice Dinakaran, against whom impeachment proceedings have been initiated in the Rajya Sabha, to go on leave.
    Justice Dinakaran has rejected the demand.
    Following the rejection of his demand, Justice Kumar took an unusual step. He made his views public by posting his views on the blog.
    “This kind of response from the Chief Justice (Dinakaran) has only confirmed my worst fears that he may even now continue to abuse and misuse his powers (including the powers to recommend the names of persons to be appointed as judges of the High Court after eliciting the views of his colleagues in the collegium) even when he is no more discharging his duties as Chief Justice of the HC,” Justice Kumar wrote on his blog on December 17.
    But this was only a precursor to the bombshell he dropped on December 25. Without attacking Chief Justice of India (CJI) K.G. Balakrishnan, Justice Kumar said bluntly in public what was being whispered in legal circles so far.
    Referring to the Justice Dinakaran issue and the helplessness of the CJI in the matter, he wrote on his blog: “The concept
    that the Chief Justice of India, being the head of judiciary in the country, and therefore, can exercise his moral
    authority to ensure that erring judges fall in place and behave themselves, is a misnomer and misconception.”
    Going a step further, the judge used an expression many jurists completely disagree with. Justice Kumar compared the institution of the CJI to a “serpent without fangs”.
