A 17-year-old girl has been jailed for more than a week now to ensure she testifies against an ex-convict accused of abducting and raping her.
The unidentified Sacramento teen has been held on a material witness warrant to guarantee her presence at the trial of Frank William Rackley, who is accused of three counts or rape, scheduled to begin on April 23.
Rackley, who weighs more than 200 pounds and bears a swastika tattoo on his chest, is charged with raping the girl in his pickup in July. Prosecutors say a rape examination found Rackley’s DNA
The 37-year-old ‘threw [the victim] into the driver’s side of the truck,’ and ‘drove to a dark spot on a residential street and parked,’ before raping the girl and pushing her out of his vehicle, according to court documents.
The girl’s lawyer will ask Judge Lawrence G. Brown to set her client free at a hearing scheduled today.
‘I think it’s outrageous that the DA‘s Office wants to put a rape victim – a juvenile rape victim – in custody, as if she were the criminal, in a case where she is the victim,’ attorney Lisa M. Franco told the Sacramento Bee.
‘What this is serving to do is only making victims out there – potential victims and future victims – not want to come forward because they’re going to have to go to jail, because they’re afraid to testify,’ she added to CBS Sacramento.
