    The recent WikiLeaks expose of US Embassy Cables have disclosed that AK Antony , Defense Minister of India was the one ,apart from Priya Ranjan Das Munshi, Youth Congress  Leader of the Emergency imposed Period in India,to oppose Sanjay Gandhi, the extra Constitutional Power Center at that time.

    It is also credited  with  Jayalalithaa, the then Chief Minister, Tamil Nadu,India with flushing out the LTTE in the State.

    These facts we know and why AK  Antony is in a prime post in the dispensation of Sonia Gandhi-enemy of enemy is my friend!

    The curious fact is not these facts themselves , but who revealed this information to US Embassy officials.

    “The cable quoted a private assessment given by a Times of India correspondent who covered the session to his editors. The reporter noted, “that, unlike AICC sessions earlier this year in Chandigarh and Delhi where there was heavy rush by ministers and other politicians to pay respects to Sanjay, this time an attitude of sullenness prevailed and aside from handful of hangers-on, there were few “foot kissers”.

    How come this information reached the US Embassy Officials?

    “A bureaucrat, who held a key security portfolio at the time, told post (embassy officials) that Jayalalithaa ordered him to do ‘whatever it takes to finish off the LTTE’ in Tamil Nadu, even if it required extrajudicial killings of LTTE associates in the state,” said a dispatch sent by the then US consul general in Chennai, Andrew T Simkin. The cable further added that she is an “iron lady” and “even her fiercest critics acknowledge that Jayalalithaa’s aggressive approach went a long way towards pushing the LTTE out of Tamil Nadu”.

    In this case the informer is a Senior Bureaucrat from the Government of Tamil Nadu who was handling the LTTE issue!

    Story:

    Editor of Maharashtra Times told US diplomats that foreign minister Y B Chavan confided to him that he was hearing increasing murmurs of dissatisfaction from Congressmen at the treatment being accorded Sanjay and the disdain being displayed for traditional Congress politicians.

    The cable said at one point in Youth Congress session in Guwahati, its president Ambika Sonicomplained that Congressmen sometimes “obstructed” Youth Congress work: “their fear is that if the Youth Congress workers forge ahead by dint of their work, their chairs will be threatened. We do not want their chairs.”

    Soni was made the YC president after Sanjay ousted Das Munshi. The cable described Soni as “an attractive, well-educated, outspoken but intellectually weak personality who has been working in the All-India Congress Committee (AICC) bureaucracy since 1969.”

    Meanwhile, in Kerala, the faction led by Antony and a large section of people were very critical of Sanjay’s growing importance. A cable from the US embassy said that their impression was that “Sanjay Gandhi is not very popular in that state”

    “On the contrary, the US mission officials had written to their bosses in April 1990 that then chief minister M Karunanidhi was tilting towards the LTTE. The cable sent almost a year before his government was dismissed, said his pro-LTTE stand was generating widespread controversy and dismay in Tamil Nadu, particularly in the light of his strained relations with the Tigers in the past.

    He was burning bridges with Delhi because of his hardliner pro-Tamil Eelam stand, the cable said and added that it may be at significant political cost. The US mission also raised suspicion as to whether Karunanidhi had put up with the LTTE activities in Tamil Nadu out of fear for the terrorist group.

    One should not discount the role of the government of India in supporting the LTTE. It should not have permitted the LTTE to operate from Indian soil, said G Parthasarathy, former diplomat, who was in Rajiv Gandhi’s office from 1986 to 1989. “Karunanidhi was viciously critical of the LTTE in the past. But once he returned to power in 1989, he turned an LTTE supporter,” said Parthasarathy. His mistake was that he allowed the constitutional machinery to break down in Tamil Nadu as LTTE ran riot, he said. The 1991 electoral verdict was against the LTTE and terrorism and Jayalalithaa was just fulfilling her constitutional duty in flushing them out, Parthasarathy added.

  • Reinstate TN workers- Judgement . Court Whistling in the dark?

    The High Court of Tamil Nadu has been ordered to take back the people Welfare Workers ,appointed by the last DMK Government.

    In its order has condemned the practice of a Government to nullify the decisions of the previous Government.

    Questions arise.

    1.Where was the Court when The Central Government and State Governments  changed the decisions of the earlier Governments?

    2.Does the Court have jurisdiction in these affairs as these are passed by The Legislature?

    The present judgement is called ‘whistling in the dark’

    Chennai, Jan 24 (TruthDive):  The Madras High Court on Monday struck down the Tamil Nadu government order sacking People Welfare Workers appointed during the previous DMK regime.

    Ms Jayalalithaa had sacked all the 13,000-odd “Makkal Nala Paniyalargal (People Welfare Workers), appointed during the previous DMK regime  in one go in November last year on the grounds that their services were redundant and there were enough staff to look after their works. This triggered a wave of protests by the sacked workers.

    The workers were first appointed in 1990 by the DMK regime and all of them were sacked after Ms Jayalalithaa assumed office in 1991. After the DMK came to power in 1996, they were reinstated again, only to be sacked by Ms Jayalalithaa in 2001. When DMK came to power again in 2006, Mr Karunanidhi appointed them again and brought them under Special Time Scale of pay.

    But, after she came back to power in May this year, the workers again become victims of politics when the AIADMK government disbanded their posts and sacked them in one go. This triggered a wave of protests by the sacked workers. The Opposition DMK also staged a demonstration and various political parties condemned the government’s action and demanded that all of them should be reinstated.

    Petitions were filed by Tamil Nadu Makkal Nala Paniyalargal Munnetra Sangam and the Dindigul Mavatta Makkal Nala Paniyalargal Nala Sangam in the Madras High Court. Ms Justice K Suguna directed the government to reinstate all the sacked workers. Quashing the GO sacking the 13,000-odd workers,the Judge also directed the government to restore all the benefits extended to them.”

    THE FUNDAMENTAL RULES OF THE
    TAMIL NADU GOVERNMENT.

    CHAPTER I—EXTENT OF APPLICATION
    1. These rules may be called the Fundamental Rules. They shall come into force with effect
    from the 1st January 1922.
    RULING.
    The President of the Republic of India and the State Government may, by general or special
    orders, permit deviations from any provisions of a purely procedural nature contained in any rules
    made or confirmed under Article 309 of the Constitution of India provided that such deviations shall
    not affect the conditions of service, the pay and allowances or the pensions of officers subject to the
    rule-making control of the President of the Republic of India.
    2. The Fundamental Rules apply, subject to the provisions of Rule 3, to all Government
    servants paid from the Consolidated Fund of the State and to any other class of Government
    servants to which Government may by general or special order declare them to be applicable.
    The Government may, in relation to service, under their administrative control, other than AllIndia Services, make rules modifying or replacing any of the Fundamental Rules:
    Proviso deleted (G.O.Ms.No.90 P&AR (FR.IV) dt. 5.7.2003 – w.e.f. 19.3.2003).
    Note 1.—A Government servant who is paid from the Consolidated Fund of the State and who is
    temporarily transferred to any of the Defence Services shall remain subject to these Fundamental
    Rules.
    Note-2.—The Service Rules shall be taken to embody and indicate fully all the provisions
    governing the services concerned. As laid down in the Service Rules the Fundamental Rules shall
    govern a service, only in the matter of leave, leave salary, pension and other such conditions of
    service, as have not been provided for in the Service Rules. If any provision of the Fundamental Rules
    is repugnant to any provisions of the Service Rules, then the provisions of the Service Rules shall
    prevail and the provisions of the Fundamental Rules shall, to the extent of the repugnancy, be void.

  • The Hindu Stoops to new Low level.

    The Hindu was once the trusted Newspaper of  Tamilians.

    There were people who will feel restless if they did not get a  copy of The Hindu in the morning.

    Such was the objectivity and trust that people used to refer to the Hindu for confirmation in it even for Gazette Notification.

    People use to quip that if one were to check the Obituary, The Hindu would take 10 Days to confirm the News, coinciding with the Tenth Day Ceremony of the departed, while The Indian Express and The Daily Thanthi will publish Obituary anticipating one’s Death!

    So thorough was The Hindu’s verification of a News Story and the commitment to Facts and Truth.

    ‘ The Hindu’ is no more.

    Unverified News items are flashed,though couched in jugglery of words to escape Legal proceedings.

    Take for instance the news item on Nakkeran‘s scurrilous article on Jayalalithaa, The chief Minister of Tamil Nadu on her eating habits.

    Nakkeran’s standard of writing is known to every one,a magazine of sheer yellow Journalism bordering on porn.
    It has been enjoying immunity  under the guise of protecting ‘the Tamils’,especially when Karunanidhi is in power.
    Nakkearn’s Editor  Gopal played a dubious role in the abduction and release of the Kannada Matinee Idol Dr.Rajkumar by the forest brigand Veerappan.The story of ‘missing millions of the ransom’ is yet to be solved.

    Nor Gopal’s credentials as one who is in cahoots with Tamil separatists/terrorists is disproved.

    Such is the fame of the Nakkeran.

    The Hindu, not only published the story of Nakkeran in its front page, but to help those who might have missed the Tamil piece,provided a Translation!

    Nakkeran has apologise unconditionally for the Story.

    Now, look at the news item in The Hindu covering the Legal Notice slapped on The Hindu for this article by Jayalalithaa.-tucked away in the eighth page corner!

    Gone are the days when The Hindu used  flash international News on the front page, quoting Reuters,New York Times and the like.

    On reporting a number of cases decided against the Government of Tamil Nadu  by the Courts, The Hindu reports in such a way as to create the impression that the Government was wrong and was strictured.

    Note the reporting on the High Court’s order on the propose conversion of The Oil Tanker of a Secretariat built by Karunanidhi,which was ‘declared open’ when civil works were on and the function was held in ‘set” erected by a Film Art Director!

    The Court has merely observed that the Government must obtain Fresh NOC from Pollution board and other Agencies before converting the building it into a Hospital as the Old NOCs were not sufficient.

    This news is presented in The Hindu in such a way as to convey the impression that the Court has quashed the Tamil Nadu Governments move and that it is illegal.

    Similar reporting on all the Court Judgements involving Jayalalitha head Tamil Nadu is being published in The Hindu.

    Probably it is more to with N.Ram’s familial relation with KarunanidhI.

    In a setback to the AIADMK government, the Madras High Court on Friday granted an interim injunction restraining authorities from making any structural alterations to the new Legislative Assembly-cum-Secretariat complex at the Omandurar Government Estate on Anna Salai here until a writ petition challenging the decision to convert it into a multi-specialty hospital is disposed of.

    A Division Bench comprising Justices D.Murugesan and P.P.S.Janarthana Raja passed the interim order on a writ petition by R.Veeramani, a city advocate. It directed the authorities to file their counter by February 10. The case has been posted for February 13.

    The petitioner said the present government took a policy decision on August 19 last year to convert the new building into a multi-specialty hospital. This decision was irrational, “tainted with mala fides and is against public interest.”

    The petitioner’s senior counsel, P.Wilson, contended that environmental clearance given for the Assembly/ Secretariat complex could not be taken as clearance for conversion and housing a multi-specialty hospital.

    The Bench noted that the PWD had issued the tender notice in two dailies for carrying out civil and electrical works.

    Admittedly, as on date, no environmental clearance was obtained for the proposed modification in the new building. It was not in dispute that for a project exceeding 15,000 sq.metres, environmental clearance should be obtained from the Centre’s Environment Impact Assessment Authority.

    Though such clearance had been obtained before constructing the building, the fact remained that it was not obtained for the modification, the Bench said.

    The court said the authorities’ only contention was that the government was taking necessary action to get clearance before the building was put into use. The question as to whether the clearance was necessary prior to any modification/alteration or not should be gone into at the time of final disposal of the petition.

    For the present, it was of the prima facie opinion that the environmental clearance given for constructing the building would not include clearance for any modification. If that be so, the structure constructed at a cost of Rs.551.80 crore could not be altered and any money spent on such modification would cause huge loss to the exchequer if the writ petitioner succeeds. In that view of the matter, it said the authorities should be restrained from altering or modifying or in any manner changing the structure till the petition was disposed of.

    The Judges said their order would not stand in the way of the government obtaining environmental clearance and also taking other steps as per the policy decision.

    Under siege from  CBI and ED, SUNNETWORK is facing a new pressure from Arasu Cable of Tamil Nadu Government and is resorting to rowdyism to gain ground.

    Arasu Cable was revived by Karunanidhi himself( started by Jayalaithaa when she was in power last time and karunanidhi, who did not have time to meet the Governor on Tamil Genocide, went to Raj Bhavan to complain that Arasu cable was hurting his family Business!) to settle scores with Dayanidhi Maran in the wake of the news published by Dinakaran,a Tamil Daly belonging to SUN group to the effect that M.K.Stalin of DMK(son of Karunanidhi) is preferred over M.K.Azhagiri, another son of Karunanidhi and Union Minister of Fertilizers as future Chief Minister of Tamil Nadu.-Dinakaran office was burned and people lost lives,aides of Azhagiri were arrested , freed for want of evidence;they are now in prison in another case..more intriguing than Ludlum’s Novels)

     

    Later the Family united and Karunanidhi shelved the Arasu Cable TV started by the Government with an investment of 100 crores.

     

    The IAS officer,Umashankar was suspended for trying to promote the Arasu Cable.

     

    Now Jayalalithaa has revived the Arasu Cable and it has become operational in Tamil Nadu,other than Chennai.

     

    There are 50,000 Cable operators in Tamil Nadu with 1,45,00000 connections.

     

    34,400 Operators have joined Arasu Cable.

     

    This has hit SUN Cable Vision.

     

    SUN has started ,in fact it has been the case since the inception of the Cable arm of SUN, blackmailing the operators into joining their Net work and leave Arasu Cable.

     

    Arasu Cable is offering 90 free channels @Rs.70/month against Rs 150-200 for SUN.

     

    It has popular packs excluding SUN NETWORK.

     

    Fun is that Kalignar TV,a Company run by M.K.Kanimozhi, daughter of Karunanidhi who is in jail for 2 G scam is included in the Arasu Cable pack!

     

    By force, because their party was in power,SUN TV has confiscated the connections of cable operators inChennai,Madurai,Tiruchi,Coimbatore,Tiuppur,Thanjavur and Erode.

     

    In 2009,30 Cable Operators‘ families who have resisted SUN TV have been forced to flee from Thanjavur.

     

    SUN is earning about Rs. 12 Crores /month from these forcibly obtained connections.

     

    The MSO’s are being threatened to be with SUN.

     

    Now that the Government has changed, SUN is resorting to cutting the Cables of the Operators who are with the Arasu Cables.

    By attaching a Gadget priced at Rs 100,  to the Cables of those who do not have SUN package, SUN ensures that the picture quality becomes very hazy.

    They have also infiltrated the Operators who have joined Arasu Cable  and are taking out processions and demonstrations purportedly from Public that Popular Channels(read SUN Network are not available in Arasu Cable).

     

    Because of these tactics, TV viewers are switching to DTH, where again SUN is offering their packs at throw away prices.( please read my blog on ‘Choosing your Cable/DTH’) 

     

    SUN also causes leakage  in Arasu Cables and makes SUN available in the Arasu package, which is illegal.

     

    SUN is fighting this issue in the Court stating that they have no hand in this.

     

    As the Arasu Cable is becoming popular, it is reported that those that have paid SUN TV to include their packs , are demanding their money back

  • Minnesota Goverment Shuts Down.Tamil Nadu?.

    Recently the Federal Government of United States came close to shutting down due to tug of war between Democrats and Republicans on Financial policies of Obama.

    Now Minnesota.

    It is understandable in US as the parties are fighting over the policies to ensure that the Federal/State government does not break down,in India ,especially in Tamil Nadu where Karunanidhi gave away by way of Freebies like color televisions etc. just to capture votes, which did not materialize.

    If the report attributed to Jayalalithaa, current Chief Minister of Tamil nadu has a Budget deficit of Rs one lakh crores  is True,only God alone can help Tamil Nadu.

    Hope Jayalaithaa manages and she will as she has in the past.
