Reliance Owns Swan Radia Saw Dossier

It has been quite some time since I wrote on 2G.

Reason , there is nothing to write about;I observed in the last post on 2 G I mentioned that the 2G will be in cold storage for some reason or another, including JPC Enquiry, a sham, till the Lok Sabha elections are announced.

Now that Elections are round the corner, the case is being dusted up.

Be assured, those who imagine some thing may come out of it,nothing will come out of this 2G scam

This will be used for Blackmail and counter Blackmail by the Parties concerned to fix alliances for Lok Sabha elections.

Now Radia has disclosed that she saw dossiers indicating that Swan was owned by Reliance.

Story:

During the process of allocation of 2G spectrum, there were dossiers in circulation saying that Swan Telecom — a company promoted by Shahid Balwa – actually belonged toReliance Communications, former corporate lobbyist Niira Radia told a special CBI court on Tuesday.

Radia, who appeared before the court for the first time as a CBI witness in the 2G spectrum scam case, however, said she did not have “personal knowledge” of the fact. “At that time, there were dossiers in circulation stating that the company (STPL) belonged to Reliance Communications, though I do not have any authentic or personal knowledge,” she told special CBI judge O P Saini.

During the hearing, 53-year-old Radia, dressed in a green suit, said Tata Teleservices Ltd, which was ahead in the queue for allocation of 2G spectrum, lost the race while an “ineligible” Swan Telecom, accused in the case, was granted radio waves.

2G Etisalat closes operation, Subscribers! File Damage Claims.

UAE-based Etisalat has decided to shut down its India operations — Etisalat DB that has over 16.7 lakh mobile subscribers — following the Supreme Court order which cancelled 122telecom licences in the 2G spectrum allocation scam.

In the 2G scam, the consumers are the casualty.

What is shocking is the people who have swindled get excuses, by hiring highly priced attorneys from the Law through the Provisions of Law meant to protect the innocent!

Balwa,Kalaignar TV,Kanimozhi, Ruias,Khaitans honchos of Reliance are scot free.

Now Etisalat is quitting.They will pass on the loss(if they have suffered at all) to their shareholders, the perpetrators,the executives will go scot-free.

The Government of India,read Congress and DMK,having swindled the exchequer now will make new set of guidelines to make more money.

I suggest that the affected subscribers file damages against Government of India which should in turn claim the damages from Etisalat for having obtained Licences illegally and leaving the subscribers in the lurch.

I am whistling in the dark of course.

( I know some smart-alec lawyer will call me an idiot and that there is no sense in what I am talking.)

Law is something , Natural Justice is something else.

“Etisalat, which holds the majority stake Etisalat DB, is the second foreign telecom company to exit India after Baharain Telecom which offloaded its 42.7 per cent stake in S Tel.

In an e-mailed statement Etisalat said, “As unanimously resolved by the Board this evening, Etisalat DB will be taking steps to reduce operating costs, including the suspension of its network and services, pursuant to the terms of its UAS licenses.”

“The decision has been taken in order to protect the interests of all stakeholders and to avoid incurring further costs at this time of rapid change and continued uncertainty in the Indian telecommunications sector,” Etisalat said.

Further information, including the official cessation date will be communicated shortly to customers through the appropriate channels, the statement added.

2G Scam-SC Verdict -70 Millions Switch, Govt.Gets Rs.13,740 Crore.

Apart from cancelling 122 Licences, the SC has confirmed that there has been a loss to the Government despite Kabil Sibal’s assertion to the contrary, the important fact is that the government has netted additional 13,740 crores.

The Customers numbering about 70 Millions may have to switch operators.

Real fall out is that the crime has been confirmed and consequently the perpetrators, hopefully, will be punished.

The Government has been trying to side track the issue by declaring that there was no loss and CAG’s figures were notional.

With Dr.Subramanian Swami breathing down the neck of P.Chidambaram, whose compliance in this scam is a certainty,the case is expected to turn the heat on the Congress and probably set in motion a new alignment at the centre and the next election may well be a water shed in India Political History.

“The cancellation of licences held by nine telecom companies will straightaway bring Rs 13,740 crore to the Government apart from the expected bonanza from the spectrum auction.

The clauses 5(G) (xiii) and 6 of telecom licence guidelines empower the Government to confiscate the entry fee, Finance Bank Guarantee (FBG) and Performance Bank Guarantee (PBG) in the event of licence cancellation due to the fault and fraud committed by the telecom operators.

According to Thursday’s judgement given by Supreme Court judges Justices GS Singhvi and AK Ganguly, all the 122 licences were cancelled because they were awarded in “illegal, arbitrary and unconstitutional” ways. “Hence the entire amount paid by them would be deemed to be confiscated,” said a top DoT official.

These nine companies paid Rs 9,013.94 crore as entry fee, which is now non-refundable as the court has held that the companies violated norms. For the licences, these companies paid Rs 3,390 crore as FBG and Rs 1,316 crore as PBG. In total, these operators deposited Rs 13,719.94 when they obtained licence in the controversial 2G spectrum allocation.

“In case of not adhering to licence conditions envisaged in para 5.G, the licence(s) granted to the company shall be deemed as cancelled and the licensor (Department of Telecom) shall have the right to encash the performance/financial bank guarantee(s) and the licensor (Department of Telecom) shall not be liable for loss of any kind,” say the clause 5G(xiii) of the existing Guidelines for Unified Access Services License, which came into force in December 2005. The clause 6 specifically mentions that the entry fee is “non-refundable”.

The SC verdict is in line with the CAG report which found that entire licences were allotted in illegal ways. The CAG report specifically mentioned that out of the 122 licences, 85 licences owned by Swan Telecom, Unitech, Loop, Videocon and STel were totally “ineligible” and based on forged documents.

The confiscated figure of Rs 13,719.94 crore from the cancelled licences will be in addition to the Rs 20 crore in the form of fine these companies will have to pay as per court’s directive. The SC had imposed Rs 5 crore as fine each on three companies for offloading shares to foreign companies and Rs 50 lakh was imposed on four companies for other violations.

Nearly 70 million subscribers may have to change their operators as a result of the Supreme Court’s ruling to cancel licences, according to reports.

The Telecom Regulatory Authority of India reportedly said that there will not be much impact on customers as around 95% subscribers belong to operators which got licences before January 2008.

“Customers will not be impacted from the cancellation of licences, TRAI Chairman reportedly said.

The Supreme Court has given a four-month window to the Government and the operators to implement its orders.

At this rate the accused and witnesses might even sue the CBI for interrupting them in their legal vocation of bribing and cheating!

The CBI should have invented a reason to throw these guys ,including Raja and Kanimozhi for lodging them in jail under Goondas Act.

A Delhi court today asked CBI to file its response to the allegation of an accused in the 2G spectrum allocation scam case that the agency resorted to an “unhealthy practice” of calling a witness “unofficially” to its office in a bid to “tamper” with the evidence.

Special CBI Judge O P Saini issued a notice to the agency seeking its response by November 23 on a plea filed by Vinod Goenka, a director of Swan Telecom and an accused in the case.

Advocate Majid Memon, appearing for Goenka, filed the application saying prosecution witness A N Sethuraman, Group President of Reliance ADA Group, was “unauthorisedly” and “suspiciously” called by CBI two days before recording of his statement on November 11 in the court.

This was done in the name of refreshing his memory and it amounted to interfering with the trial in an illegal manner, Memon alleged.

The allegation also got the support from Sethuraman, whose cross examination concluded today as he testified “the CBI official did say to me to follow whatever I had earlier stated in my statement (given to the agency).”

“It has transpired in the cross-examination of Sethuraman that shortly before giving of evidence, the witness (Sethuraman) was suspiciously and unauthorisedly invited to the CBI office by a CBI officer and was given his statement under section 161 CrPC to be read for the first time. This is impermissible in law.

Karunanidhi involved Tamil Nadu Government in 2G Scam

Not content with swindling the Government of India for not less than Rs.1,76,000Crores,Karunanidhi involved the Government of Tamil Nadu into filling up the coffers of those who benefited from 2G operation ( of course. they paid for services rendered), by giving ETA Star Insurance Company ‘Kalaignar Kaappeettu Thittam’-a welfare measure to attend to the illness of the down trodden.

Established Companies like Oriental Insurance,United India Insurance ,ICICI have been overlooked ad ETA Star was chosen for the scheme.

In 2009 Tamil Nadu Government paid a Premium of Rs.517 Crores whereas the Hospitals received Rs.415 Crores.

In the Next year the premium was Rs.750 Crores.

The Company is said to have earned Rs 400 Crores from this deal till now.

Not only this.

The Construction of new Government Headquarters,Chennai was handed over to East Coast Constructions, a Company belonging to this Group.

ETA ( not ETA Star)is a Company started by B.S.Abdul Rahman of Keezhakkarai,Tamil Nadu and he is known to be close to powers that be irrespective of who comes to power.

Anna Fly over,Valluvar Kottam etc are those some of the projects executed by ETA during Karunanidhi’s Regime.

He employed his distant relative Salauddin in his Company.

In a short while Salauddin started his own Company ETA STAR.

He developed contacts like his mentor.

The Group is into Infrastructure,Surface Transport,Shipping,Real Estate,Metro Rail, Air conditioning Technology and Automobiles among other businesses.

It has Branches in 22 Countries and is estimated to have a turn over of Rs.16,000 Crores.

The company was given to execute the New Secretariat Project with an original estimate of Rs 700 Crores which was revised to Rs. 1,200 Crores.

2 G Connection.

Swann telecom was one of the beneficiaries of 2G.

Nine months after Swann got the licence, it was bought(57% )by Etisalaat of Dubai.( I have blogged on this please see under ‘Corruption’).

It changes its name to Etisalaat DB .

In three months Genex Exim Vendors buys this from Etisalaat DB.

Genex Exim Vendors is a Company at Chennai was stated with a capital odf Rs. One lakh.

This Company belongs to ETA Star Salauddin’s son.

This company gave away Rs. One crore o 7/1/2008 to ‘Sangamam‘ programme of Kanimozhi.( You may read about this under’Corruption’).

Now Jayalaithaa has instituted an enquiry into New Secretariat Project and another one on ETA Star involvement in State welfare scheme.

Let us see what comes of it.

Citing security concerns on UAE-based Etisalat link with Pakistan and Afghanistan-based telecom companies, the Home Ministry is likely to explain before the Delhi High Court on Monday why it objected to further investment by Etisalat in India. Etisalat was denied clearance by Foreign Investment Promotion Board from hiking its stake in its spectrum-scam tainted Indian venture.

The Ministry is also likely to express its concern over the association of Shahid Balwa with Etisalat DB Telecom as its director. This company was earlier known as Swan Telecom, which is facing CBI and ED probes in the 2G spectrum scam.

The Union Home Ministry will submit its objections in sealed cover before the Delhi High Court in the case filed by Shahid Balwa. He had approached the court against the Government’s decision to reject the selling of Chennai-based Genex Exim’s 5.7 per cent shares to UAE’s Etisalat.

Sources said the Home Ministry has objected to Etisalat’s shareholding in Pakistan Telecommunication Company Limited (PTSL) and Balwa’s presence in the venture. The PTSL is considered an ISI-controlled company by Indian security agencies. Etisalat has also presence in Afghanistan telecom companies. The Home Ministry also objected to the selling of shares of the controversial company Genex Exim, controlled by NRI tycoon Sayed Salahuddin’s son. Salahuddin is a close associate of DMK patriarch and Tamil Nadu Chief Minister M Karunanidhi.

The shareholding of Genex Exim in the Swan Telecom is already under CBI radar and the offices of this little known company in Chennai were also searched by the investigators during the nationwide raids in December.

“We can’t share information on our affidavit to court. We will put the information in a sealed cover and can’t share any sort of details,” said officials of the Home Ministry.

According to sources, the Home Ministry would submit sensitive information on Balwa by Intelligence Bureau, who along with his associate Vinod Goenka had taken over Swan Telecom from Reliance Communication in October 2007.
