  • Pratibha’s killer deserved a stricter judgement’

    A judicial system is in place and law is taking its course.The delay by the fast track court is condemnable and immediate corrective action is required by law.
    Also the complaint by the uncle of the deceased that he noticed collusion between the defense lawyer,Court and investigating officer for the delay( as made out by him in Times Now Channel)is to be investigated immediately by the court suo moto.
    Barring this, the strident clamor for death Sentence seems to be hysterical and people who say this must clarify whether they are for Capital Punishment, which is inhuman as killing by society is as heinous as killing by individual ,if not worse.
    What connection is there for raking in the name of the son-in-law?
    What is the point in publishing neighbor’s account on relationship between husband and wife excepting that it is tickling to oglers.

    Story:

    Those who saw Pratibha grow up were disappointed after the unexpected judgment on Friday. Her death had shocked them and the judgement came as a bigger shock.

    They unanimously felt that the brutal murder deserved the death penalty. Though they suspect that the crime wouldn’t have been committed by Shivakumar alone.

    One of Pratibha’s neighbours, TN Seetha Ramaiah, said, “This is not right. Pratibha’s killer deserved a stricter judgment.”

    Sharadamma, another neighbour, said: “Earlier, the judgement used to come in a few days, and in such a case, the accused would have been beheaded [sic]. This case took close to four years and then came up with such a dissatisfying judgment.”

    Shivakumar had screamed his innocence many times, alleging others. Sharadamma, added, “Pratibha’s marriage itself seems pre-planned and her mother felt something was wrong from the beginning. She didn’t approve of the marriage, but couldn’t go against her daughter’s will. Her husband was a greedy man and had used Prathiba’s debit cards for his purchases. Even the house in Kumaraswamy layout, where Pratibha was residing was purchased with Gowramma’s money. He even bought a car using her account and had once forced Gowramma to transfer the property to his name. That was the last time he ever approached Gowramma.”

    There was also palpable fear among the residents of the area. A 79-year-old Rukmini, after much cajoling, said, “After Pratibha’s death, we all are scared even to open the door. Such judgements are only giving leeway for such crimes. By appealing to the higher courts, the criminals can go scot-free. Death was all that would have brought a minimal amount of justice to Gowramma.”

    Rukmini resides on the ground floor of the house, which is rented by Gowramma. “Whenever she feels lonely, Gowramma comes to me, seeking emotional help. Her daughter was the only reason for her survival. Her son-in-law doesn’t care for her,” Rukmini said.

  • Lifer for Pratiba murder.

    The Govt may appeal for ‘real lifer’ and not 14 years with reduction in term for good behavior.
    Execution by State is no better than murder by the individual.
    The issue to be raised by the media should be to punish the guilty who have formed a nexus in delaying justice.Judges are not holy cows.

    It is widely known that there exists a nexus between judges,(not all), investigating authorities and the defense lawyer.
    No sense in talking about system reformation with  corrupt individuals .


    On this subject media, especially Times Now has been literally screaming for Death sentence for the accused.

    The media has not yet made up its mind on whether Death penalty should be abolished.Does the media  want death penalty to stay?

    Murder by state is as reprehensible as by the individual.

    What if the decision by the Court is at fault?

    There are instances where the accused have languished in jails for 8 to 10 years  bur were acquitted?What then?

    No point in getting hysterical about an individual case.

    The issue in this case is one of inordinate delay in delivering judgment, the delay due to frivolous reason as adjournment for silly reasons .Law should be amended to correct this.

    It is also a known fact that there exists a nexus between some judges, investigating officers and defense lawyers.

    This has to be viewed seriously and stringent has to be taken against the guilty including the judges.

    Lawyers must take only such cases that are worth taking based on the veracity of the case.They should have a conscience while taking a case.
