    [இலண்டன் (London)] – தமிழீழ விடுதலைப் புலிகள் (எல்ரீரீஈ) என சந்தேகிக்கப்பட்ட உறுப்பினர்களையும் அதன் ஆதரவாளர்களையும் துன்புறுத்துவதற்கு இலங்கையின் ஆயுதப் படைகள் பாலியல் வல்லுறவையும் ஏனைய பாலியல் வன்முறைகளையும் பிரயோகித்து வந்துள்ளதாக மனித உரிமைகள் கண்காணிப்புக் குழு (Human Rights Watch)இன்று வெளியிட்ட ஒரு அறிக்கையில் குறிப்பிட்டுள்ளது. 2009 ஆம் ஆண்டு மே மாதம் முடிவடைந்த ஆயுதப் போராட்டத்தின் போது சிறையில் பரந்தளவில் பாலியல் வல்லுறவுகள்  நிகழ்ந்து வந்தன எனவும், அதே வேளையில் அரசியல் நோக்குடனான பாலியல் வன்முறைகள் இராணுவத்தினாலும் போலீஸ் படையினாலும் தொடர்ந்தும் மேற்கொள்ளப்பட்டு வருகின்றது எனவும் மனித உரிமைகள் கண்காணிப்புக் குழு கண்டறிந்தது.

    “‘நாங்கள் உங்களுக்கு ஒரு பாடம் புகட்டுவோம்’: இலங்கை ஆயுதப் படைகளின் மூலம் தமிழ் மக்களுக்கு எதிராக நிகழ்த்தப்பட்ட பாலியியல் வன்முறை’” என்ற 144 பக்க அறிக்கையானது இலங்கை முழுவதிலுமுள்ள உத்தியோகபூர்வமான மற்றும் இரகசியமான தடுப்பு முகாம்களில் 2006-2012 ஆம் ஆண்டு வரை நிகழ்ந்த பாலியல் வல்லுறவுகள் மற்றும் பாலியல் துஷ்பிரயோகம் ஆகியவற்றுக்கு எதிரான 75 பேர்களின் குற்றச்சாட்டுக்கள் பற்றிய விரிவான விபரங்களை தருகின்றது. மனித உரிமைகள் கண்காணிப்புக் குழு ஆவணப்படுத்திய விடயங்களில், பல நாட்களாக அடிக்கடி பல நபர்களினாலும், இராணுவத்தினாலும், போலீஸ் படையினாலும், மற்றும் அடிக்கடி பங்குகொள்ளுகின்ற அரசாங்க சார்பு துணை இராணுவக் குழுக்களினாலும் தமிழ் ஆண்களும் பெண்களும் பாலியல் வல்லுறவுக்கு உட்படுத்தப்பட்டு சித்திரவதை செய்யப் பட்டிருப்பதாகப் பதிவாகியிருக்கின்றது.

    “இலங்கையின் பாதுகாப்புப் படைகள் கூறவியலாத எண்ணிக்கை அளவுக்கு சிறையில் தமிழ் ஆண்களையும் பெண்களையும் பாலியல் வல்லுறவுக்கு உட்படுத்தி சித்திரவதைக்கு உட்படுத்தியுள்ளனர்” என மனித உரிமைகள் கண்காணிப்புக் குழுவின் ஆசிய பிராந்தியத்திற்கான பணிப்பாளர் ப்ராட் அடம்ஸ் (Brad Adams) கூறினார். “இவை சாதாரண யுத்தகால அட்டூழியங்கள் அல்ல, தற்பொழுதும் அந்த அட்டூழியச் செயல்கள் தொடர்ந்தும் நிகழ்ந்து வருவதோடு, எல்ரீரீஈ தரப்புடன் தொடர்பு இருப்பதாக சந்தேகத்தின் பேரில் கைது செய்யப்படும் ஒவ்வொரு தமிழ் ஆணையும் பெண்ணையும் இது கடும் ஆபத்தில் தள்ளிவிடுவதாக அமைகின்றது”.

    தலைப்பெழுத்துக்கள் அனைத்தும் புனைப்பெயர்களாகவும் நபரின் உண்மையான பெயருக்கு எந்தவிதமான தொடர்பும் இல்லாததாகவும் இடப்பட்டுள்ளன.

    ஜே எச் (JH) என்பவரின் சம்பவம்

    ஜே எச் (JH) என்பவர் 23 வயதுடைய ஒரு தமிழர். இவர் ஐக்கிய இராச்சியத்தில் கல்வி கற்றுக்கொண்டிருந்த நேரம் 2012 ஆம் ஆண்டு ஆகஸ்ட் மாதத்தில் குடும்பம் சார்ந்த காரணங்களுக்காக கொழும்புக்குத் திரும்பினார். ஒரு மாதம் கழிந்த பின்னர், வேலை விட்டு வீட்டிற்குத் திரும்பிக்கொண்டிருந்த நேரத்தில், ஒரு வெள்ளை வேனில் வந்த பலர் அதிலிருந்து குதித்தார்கள். ஒரு விசாரணைக்கு தான் தேவைப்படுவதாகக் கூறி, அவர்கள் தனது கண்களைக் கட்டி, ஒரு மணித்தியாலத்திற்கும் அதிகமான நேரம் பயணித்து, தெரியாத ஒரு இடத்திற்கு தன்னை எடுத்துச்சென்றதாக அவர் மனித உரிமைகள் கண்காணிப்புக் குழுவிடம் கூறினார்:

    கட்டியிருந்த எனது கண்களை அவர்கள் அவிழ்த்துவிட்ட [போது] நான் அங்கு ஏனைய நான்கு நபர்கள் இருந்த ஒரு அறையைக் கண்டேன். நான் ஒரு நாற்காலியில் கட்டப்பட்டு எல்ரீரீஈ தரப்புடன் எனக்கிருக்கும் தொடர்புகள் பற்றியும் அண்மையில் வெளிநாட்டிற்குசென்ற காரணம் பற்றியும் விசாரிக்கப்பட்டேன். அவர்கள் எனது ஆடைகளை உரிந்து என்னை அடிக்கத் தொடங்கினார்கள். நான் மின்சாரக் கம்பிகளினால் அடிக்கப்பட்டு, எரியும் சிகரட்டுக்களினால் சூடுவைக்கப்பட்டு, பெற்றோல் திணிக்கப்பட்ட ஒரு பொலித்தின் உறையைக் கொண்டு மூச்சுத்திணறடிக்கப்பட்டேன். பின்னர் அந்த இரவு, நான் ஒரு சிறிய அறையில் அடைக்கப்பட்டேன். தொடர்ச்சியாக மூன்று நாட்கள் நான் பாலியல் வல்லுறவுக்கு உட்படுத்தப்பட்டு சித்திரவதை செய்யப்பட்டேன். முதலாவது இரவு, ஒருவர் தனியாக வந்து என்னை குதவழியாகப் பாலியலுறவுக்கு உட்படுத்தினார். இரண்டாம் மற்றும் மூன்றாம் நாள் இரவுகளில், இரண்டு பேர் எனது அறைக்கு வந்தார்கள். அவர்கள் என்னை குதவழியாகப் பாலியலுறவுக்கு உட்படுத்திவிட்டு அவர்களுடன் வாய்வழிப் பாலியல் உறவுக்கும் என்னை வற்புறுத்தினார்கள். இந்தப் பாலியல் வல்லுறவுகளின் பின்னர் எல்ரீரீஈ தரப்புடன் எனக்கு தொடர்புகளிருப்பதாக ஒப்புக்கொண்டு ஒரு வாக்குமூலத்தில் நான் கையொப்பமிட்டேன்.

    ரீ ஜே (TJ ) என்பவர் 19 வயதுடைய ஒருவர். இவர் ஐக்கிய இராச்சியத்தில் தனது கற்கைகளைப் பூர்த்திசெய்து விட்டு இலங்கைக்குத் திரும்பியவர். 2012 ஆம் ஆண்டு ஆகஸ்ட் மாதம் ஒரு மாலை நேரத்தில், ரீ ஜே (TJ ) வவுனியாவில் (Vavuniya) ஒரு நண்பரைச் சந்தித்து விட்டு வீடு திரும்பிய நேரத்தில் அவருக்கு அருகில் ஒரு வெள்ளை வேனை நிறுத்தி சிவில் உடைகளை அணிந்திருந்த ஏறக்குறைய ஐந்து அல்லது ஆறு நபர்கள் அதிலிருந்து குதித்தார்கள். அவர்கள் ரீ ஜே (TJ ) ஐ பலவந்தமாக இழுத்து வேனினுள் தள்ளி, அவரின் கண்களைக் கட்டி, தெரியாத ஒரு இடத்திற்கு அவரை கொண்டுசென்றார்கள் என அவர் மனித உரிமைகள் கண்காணிப்புக் குழுவிடம் கூறினார்:

    கட்டியிருந்த எனது கண்களை அவர்கள் அவிழ்த்துவிட்ட போது நான் ஒரு அறையில் இருப்பதைக் கண்டேன். அங்கு ஐந்து பேர் இருந்தனர். அவர்களில் ஒருவர் இராணுவ சீருடையில் காணப்பட்டார். ஐக்கிய இராச்சியத்தில் எல்ரீரீஈ தரப்புடன் எனக்குள்ள அலுவல் பற்றி அவர்கள் என்னிடம் விசாரிக்கத் தொடங்கினார்கள். வெளிநாட்டில் எல்ரீரீஈ தரப்புடன் எனக்கிருக்கின்ற தொடர்புகள் பற்றி அவர்கள் என்னிடம் வினவினார்கள். நான் பதிலளிக்கவில்லை. அவர்கள் என்னைத் துன்புறுத்தத் தொடங்கினார்கள். முதலில் அறையப்பட்டும் குத்தப்பட்டும் நான் தாக்கப்பட்டேன். அப்போது அவர்கள் என்னைக் கடுமையாகத் துன்புறுத்தத் தொடங்கினார்கள். எனக்கு தடிகளால் அடிக்கப்பட்டு, எரியும் சிக்கரெட்டுக்களால் சூடுவைக்கப்பட்டதுடன் எனது தலை ஒரு நீர் பீப்பாயினுள் அமிழ்த்தப்பட்டது. கேள்விகள் கேட்கப்பட்ட நேரத்தில் உடைகள் உரியப்பட்டு நிர்வாணமாக்கப்பட்டேன்’.

    Kept hanging between life and death, between hope and despair, he has been denied even the time to accept his end and find the strength within himself to face it with dignity. This has driven him to the edge of madness and made him beg to be put to death immediately. but the Law has been as impervious to his pleas for death as it has so far been to others’ pleas to spare his life.

    Every inquiry about what the government intends to do; every demand to hasten the president’s decision on his mercy petition, has been met with the lofty response, that there are a score of ‘cases’ ahead of him in the queue, so the wheels of justice cannot be speeded up for him alone. Of all the grotesque parodies of democracy that we live with, this insistence upon equality among the condemned is the most heartless.

    But what is the grand process of Law that is taking so long? Last week we found out that it consisted of no more than some official in the Delhi state government losing Guru’s file for four years. but was his file really lost? Or was this Sheila Dixit’s favour to a central government that knows the moral and political cost of hanging Guru, but cannot muster the courage to recommend to the president that she commute his sentence to prison for life?..

    Only the hopelessly naïve will not know the answer. The truth is that from the day he was sentenced Afzal Guru has been the foil in a no-holds-barred fencing match between the BJP and the Congress. Every other consideration — the morality of the death sentence, the injunction that it be applied in the rarest of rare cases, the possible impact of his hanging upon the youth of Kashmir, upon India-pakistan relations, and upon relations between the Hindus and Muslims of India — has faded into the background.

    The match was not begun by the Congress. From the day that Guru was sentenced to death, the bjp has filled the air with taunts, diatribes, and accusations of cowardice and lack of patriotism, aimed at steamrolling Manmohan Singh’s government into hanging him regardless of the cost….

    How can the death of any one , even a terrorist create a ‘win-win ‘ situation for any one.Mr Jha oversimplifies issues and shamelessly creates propaganda for the congress. Sad to see that the calibre of people who write in Tehelka is so poor.We would like to read articles written by people who are unbiased and morally uprigh…

      Well done mr jha this guy was innocent he was charged purely on circumstantial evidence and given death penalty even the courts had there doubts but there are no doubts about modi and thackery the indian state doesn,t have the guts to charge them for killing thousands and media which is always playing on hype because its controlled by vested interests shameful democracy in democratic countries all are equal before the law in india that is unless you are muslim when the nato troops leave afghanistan next year then all the concentration will back to the eastern front the payback is surely coming

      Supreme court Judgement on Afzal Guru.

      The net result of the above discussion is that the conspiracy to commit terrorist acts attracts punishment under sub-Section (3) of Section 3. The accused Afzal who is found to be a party to the conspiracy is therefore liable to be punished under that provision. Having regard to the nature, potential and magnitude of the conspiracy with all the attendant consequences and the disastrous events that followed, the maximum sentence of life imprisonment is the appropriate punishment to be given to Mohd. Afzal under Section 3(3) of POTA for conspiring to commit the terrorist act. Accordingly, we convict and sentence him.

      The conviction under Section 3(2) of POTA is set aside. The conviction under Section 3(5) of POTA is also set aside because there is no evidence that he is a member of a terrorist gang or a terrorist organization, once the confessional statement is excluded. Incidentally, we may mention that even

      going by confessional statement, it is doubtful whether the membership of a terrorist gang or organization is established.

      We shall then consider whether the conviction of Afzal under Section 120B read with Section 302 IPC is justified. The High Court upheld the conviction and gave death sentence to the two appellants under this Section. We are of the view that the conviction and sentence on this count is in accordance with law. The conspiracy has many dimensions here. It is implicit in the conspiracy to attack the Parliament that it extends to all the offensive acts intimately associated with that illegal objective. Indulgence in terrorist acts, killing and injuring persons who are most likely to resist the attackers, using explosive devices, firearms and other dangerous things in the course of attack, ‘waging war’ against the Government of the country are all various manifestations of the conspiracy hatched by the deceased terrorists in combination with the appellant Afzal.

    Human Right watch which will be submitting its Report to UN on Monday,disclosed that The Tamil Women were raped by The Sri Lanka Security forces,’to teach them a lesson”

    In one of the most repugnant images yet seen during the so-called War on Terror, A Tamil woman between 20 and 30 years of age lies dead in the mud after being raped and shot to death by nationalist Rajapaksa military forces during the ethnic cleansing of 2009. As an increasing body of evidence now illustrates, scenes like this were common throughout the north of Sri Lanka despite initial claims by government sources that incidents of this type were exceptional. In an attempt to explain this behaviour, the Sri Lankan military have claimed that disrobing and open handed detailing of bodies is required to search for weapons, explosives or documents as standard operating procedure. In many of these incidents, females have been found naked, blindfolded with clothing removed just enough to expose sexual organs with hands tied behind the back and gunshot wounds to the head. In almost all cases, females are found in face up positions with their legs splayed. It should be noted that the operation conducted by nationalist forces in Sri Lanka has not been made possible by competent anti-terrorist training for the role, or a degree of professionalism, but by a sudden influx of finance and military weapons and ordnance from the United States and China. This influx simply brought the Sri Lankan military into a position in which it had the military capability to overshoot its natural lack of competence.

    Amidst reports of widespread sexual violence by the Sri Lankan army on suspected LTTE rebels, the Human Right Watch (HRW) has sought an international investigation.

    The investigation demands came after a report, ” ‘We will teach you a lesson’: Sexual violence against Tamils by Sri Lankan Security Forces“.

    The report is said to have contained a list of 75 cases of rape and sexual assault. These incidents happened all across Sri Lanka, from 2006 to 2012.

    The majority of the cases are said to have happened during the armed conflict (with LTTE) that ended in may 2009.

    The conflict ended almost three years ago, but the incidents of sexual violence continues till this day, the report quoted.

    The revelations were confirmed by HRW Asia Director Brad Adams.

    “The Sri Lankan security forces have committed untold numbers of rapes of Tamil men and women in custody. These are not just wartime atrocities but continue to the present, putting every Tamil man/woman arrested for suspected LTTE involvement at serious risk”, he was quoted in a news report published in national daily the Hindu.

    Adams further reiterated the necessity of an international investigation into the alleged crimes.

    Innumerable accounts of gross atrocities have emerged since the conflict ended.

    Sri Lankan security forces are accused of blackmailing and sexually harassing Tamil men and women to extract information from them related to LTTE.

    One account of 31-year-old women describes how she was blackmailed by the forces in revealing her husband’s details.

    She was mercilessly beaten by a sand-filled-pipe and raped.

    Another account of 23-year-old women was abducted and questioned for her alleged links with LTTE.

    She was raped for three consecutive days and forced to perform sexual acts with number of men. In the end, she was asked to sign a piece of paper where she confessed her link with the LTTE.

    Even men were not spared from the sexual violence.

    Graphic accounts of extreme sexual violence gave a glimpse of the atrocities committed by the Sri Lankan security forces to crush the rebellion against its government.

    The cold blooded killing of Prabhakaran’s 12-year-old son published in Britain daily – The Independent – has raised questions over Sri Lanka’s armed forces conduct during the final stages of the operation against Tamil Tiger rebels.

    According to the report in the daily, the series of photographs taken a few hours apart and on the same camera, show Balachandran Prabhakaran, son of Villupillai Prabhakaran, sitting in a bunker, alive and unharmed, apparently in the custody of Sri Lankan troops. Villupillai Prabhakarn led the Liberation Tigers of Tamil Eelam (LTTE). Another photo shows the boy’s body lying on the ground, his chest pierced by bullets.

    “The pope was originally chosen by those senior clergymen resident in and near Rome. In 1059 the electorate was restricted to the Cardinals of the Holy Roman Church, and the individual votes of all Cardinal Electors were made equal in 1179. Pope Urban VI, elected 1378, was the last pope who was not already a cardinal at his election. Canon law requires that if a layman or non-bishop is elected, he receives episcopal consecration from the Dean of the College of Cardinals before assuming the Pontificate. Under present canon law, the pope is elected by the cardinal electors, comprising those cardinals who are under the age of 80.

    The Second Council of Lyons was convened on 7 May 1274, to regulate the election of the pope. This Council decreed that the cardinal electors must meet within ten days of the pope’s death, and that they must remain in seclusion until a pope has been elected; this was prompted by the three-yearSede Vacante following the death of Pope Clement IV in 1268. By the mid-16th century, the electoral process had evolved into its present form, allowing for variation in the time between the death of the pope and the meeting of the cardinal electors.

    Traditionally, the vote was conducted by acclamation, by selection (by committee), or by plenary vote. Acclamation was the simplest procedure, consisting entirely of a voice vote, and was last used in 1621. Pope John Paul II abolished vote by acclamation and by selection by committee, and henceforth election will be by full vote by ballot of the Sacred College of Cardinals.

    All but thirteen of the Cardinals alive at the death of Pope John Paul II were appointed by him. Three of those thirteen were under 80 years old as of the day of John Paul II’s death. One of those three, Joseph Ratzinger, was elected Pope in the resulting conclave and took the name Benedict XVI, another one (Jaime Sin) did not attend that conclave for health reasons and died shortly afterwards, and the third, William Wakefield Baum, turned 80 on 21 November 2006.

    February 14, 2013, Colombo. Sri Lanka Guardian) The Indian media reported that Alok Joshi, Chief of India’s Research and Analysis Wing (RAW) had visited President Mahinda Rajapaksa at the Guest House at Tirupati, where he was staying. In practice, a meeting between the Chief of the country’s secret service and visiting foreign Head of State is a rarity. J.R. Jayewardene is the only head of Sri Lanka to have had a meeting with the chief of ‘RAW’. Usually, the chief of ‘RAW’ meets the leader of a foreign country only when there is a crucial issue pertaining to India or a perilous situation involving the country of that leader.

    “On 26 April 1988, A. Verma, the head ( Read an exclusive interview with A.K. Verma which published by the Sri Lanka Guardian on 2008 )  of RAW, flew into Colombo. Verma’s visit was known only to a handful of men in Indian and Sri Lanka. In Colombo, only three men knew about it. They were M.M. Gunaratne, Director-General, Intelligence and Security, Ministry of Defence, under whom the Special Task Force (STF) and National Intelligence Bureau (NIB) were placed, Zerny Wijesuriya, Director, National Intelligence Bureau (NIB) and President Jayewardene himself. Even people like Dixit, the high profile Indian High Commissioner, Gamini Dissanayake, influential minister and co-architect of the Accord, General Sepala Attygalle, Defence Secretary, General Cyril Ranatunge, the General Officer Commanding the Joint Operations Command, and W.M.P. B. Manikdewela, the Secretary to the President did not know. Lalith Athulathmudali, the National Security Minister, was also not fully informed – perhaps he would have been partly informed by the effective private intelligence network he operated.
    In India, Rajiv Gandhi, the Prime Minister, Grirish Chandra Saxena, the National Security Adviser to the Indian Prime Minister, Chandrasekaran alias Chandran of RAW and only two or three other officials knew. Subsequently, when two prominent Sri Lankans in the government became aware of the RAW connection, they were very annoyed.
    Verma travelled undercover and spent about 48 hours in Colombo. He tried to convince Jayewardene the LTTE was interested in joining the mainstream and that he should cooperate with the negotiating intermediary – RAW. Verma held discussions with M.M. Gunaratne on the morning of 27 April. He was well informed about the conflict, and had personally negotiated with the TULF, the militant groups including the LTTE, and was keen to obtain certain assurances from President Jayewardene before he once again met with Kittu in Madras. Verma stated that all Tamil groups were agreeable to enter the political process. He stated that the LTTE too was keen to do so, but subject to certain conditions being satisfied.
     
    RAW head meets Jayewardene
    28 April 1988 was historic day when the head of RAW met President Jayewardene. According to a high level source in New Delhi, Jayewardene was cautious. However, he cooperated at least at the beginning, and even Gandhi who intensely disliked the LTTE thought that with the support of Jayewardene, India will be successful in striking a deal with the LTTE. Verma said the LTTE is keen to “surrender 700 of the estimated 1,000 big weapons the LTTE have in their possession and they would like to retain 300 weapons for their security.” Verma added: “With the surrender, a ceasefire would be announced. The LTTE would thereafter publicly support the Accord. The balance weapons will be released gradually, once the LTTE feels assured that a climate of security has descended on the North and East.” Verma asked President Jayewardene whether he could respond to the LTTE by announcing that the Government of Sri Lanka will hold elections in the North and East for once council (under Article 37 A of the Provincial Councils Act). This was to be done when the groups were ready to enter the political process and before the date of the elections for the North and East was to be announced, and soon after all other elections were completed. Verma stated that a referendum as stipulated in the Accord would subsequently be necessary, for people to accept or reject the merger.’ Verma requested Jayewardene to make two other public statements regarding two LTTE requests as an explicit demonstration of goodwill and gesture towards the LTTE. One was to be on the release of detainees in custody. RAW was told that 3,634 had been released and only 627 were in custody, and that even they would be released in due course. The other request was on the use of the 1982 electoral register for the elections. The President agreed to the latter.
